RESOLUTION NO. 91-2 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DENYING THE APPEAL OF HEIGHT VARIATION NO. 692 AT 28737 KING ARTHUR COURT THEREBY APPROVING THE APPLICATION. WHEREAS, the applicant, Mr. Jeff Jackson has requested a Height Variation to allow a second story addition at a proposed height of 23'-6", measured pursuant to section 17.02.040 of the Development Code, at 28737 King Arthur Court; and WHEREAS, on November 1, 1990, notification of the Director of Environmental Services' decision to approve Height Variation No. 692 was sent to residents within 500 feet of subject site; and WHEREAS, on November 13, 1990, within a 15 appeal period, Mr. Russell Clark, the appellant, filed an appeal to the Planning Commission stating that his residence at 28734 King Arthur Court will be impacted because the proposed second story addition will induce sunlight blockage, and that the building wall is excessively blank and massive; and WHEREAS, after notice pursuant to the City's Development Code, a public hearing was held on January 8, 1991, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: That pursuant to Section 17.02.040 of the Development Cade and adopted guidelines, the applicant has complied with the provisions set forth for early neighborhood consultation, in that he discussed the proposed project with the neighbors within the vicinity and there is no negative response from the Homeowner's Association for this area. Section 2: That the applicant constructed a temporary space frame of the outline -of the proposed addition on September 20, 1990, the height and location of which were verified by Staff. Section 3: That the structure does not significantly impair a view or vista from public property (parks, major thoroughfare, bikeway, walkway, equestrian trial etc.) which has been identified in the City's General Plan, Coastal Specific Plan or City -approved viewing area. Section 4: That the proposed structure is not located on a ridge or promontory. Section 5: That the proposed structure has been designed and situated in such a manner as to minimize view obstruction since the 23'-6" addition would be constructed over an existing single story portion of the residence and would be set back approximately 20' behind the existing garage and 40' from the front property line. Section 6: That the proposed structure, when considered exclusive of existing foliage, does not impair a view from the surrounding residences as set forth in the City's Development Code. Section 7: That there would be no significant cumulative impact caused by granting the application since there would not be any loss of view that would contribute to incremental loss of views if subsequent second story additions, situated in a similar manner and at a similar height were approved. Section 8: That based on an analysis of the surrounding vicinity, the proposed structure is compatible with the character of the immediate neighborhood in that the proposed second story addition will match the existing two story structures in the vicinity in terms of size and scale, and architectural style and materials. Section 9: For the foregoing reasons and based on information and findings included in the Staff report and evidence presented at the public hearing, the Planning Commission of the City of Rancho Palos Verdes hereby denies the appeal of Height Variation No. 692, thereby approving the request for a second story addition at 28737 King Arthur Court subject to the conditions contained in Exhibit "AA" attached hereto and made a part hereof, which are necessary to preserve the public health, safety, and general welfare in the area. Resolution No. 91-2 Page 2 EXHIBIT "A" HEIGHT VARIATION NO. 692 28737 KING ARTHUR COURT CONDITIONS OF APPROVAL 1. Maximum height of the addition shall not exceed 23' 6". 2. The project shall comply with the required 20' front yard setback and 15' rear side yard setback. A 4' 7" sideyard setback shall be allowed on the eastern as permitted by Minor Exception Permit No. 396. 3. The applicant shall submit a Covenant to Protect Views prior to building permit issuance. 4. Approval is based on the revised plans submitted to the Planning Commission on January 8, 1991. 5.
