A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF RANCHO PALOS VERDES APPROVING
VARIANCE NO 275 AND EXTREME SLOPE PERMIT
NO. 25 TO ALLOW THE CONSTRUCTION OF AN
ATTACHED DECK AND A PORTION OF A SEPARATE
DECK TO PROJECT OVER AN EXTREME SLOPE AT
29702 GRANDPOINT LANE.
WHEREAS, Mr. Robert Lerma has requested a Variance
application to allow an attached deck which would create a
structure in excess of the 30 foot maximum allowable height and an
Extreme Slope application to allow a portion of a covered deck to
project over an extreme slope; and
WHEREAS, after notice issued pursuant to the provisions of
the Rancho Palos Verdes Development Code, a public hearing was
held on December 11, 1990, at which time all interested parties
were given an opportunity to be heard and present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS
FOLLOWS:
Section 1: That there are exceptional or extraordinary
circumstances or conditions applicable to the property which do
not apply generally to other properties in the same zoning
district, in that a lack of level land limits available area in
which to construct an attached deck so as not alter the overall
height of the residence and limits available area in which to
construct a covered deck so as not to project over the extreme
slope.
Section 2: That the granting of the Variance will not be
materially detrimental to the public welfare or .injurious to
property and .improvements in the area in that neither the attached
deck, nor the trellised deck at the lower level of the property,
will cause significant view impairment or have any adverse visual
affects to adjacent neighbors.
Section 3: That the granting of such a Variance will not be
contrary to the objectives of the General Plan or the policies and
requirements of the Coastal Specific Plan because the requests do
not alter the existing land use and this property is not located
in the Coastal Zone.
Section 4: That the site cannot reasonably accommodate the
trellised structures in another location not involving the extreme
slope since there are no other flat, level yard areas besides the
existing sports court area which the property owner wishes to
maintain.

Section 6: For the foregoing reasons and based on the
information and findings included in the Staff report and records
of the proceedings, the Planning Commission hereby approves
Variance No. 275 and Extreme Slope No. 25 subject to the
conditions contained in Exhibit "A" attached hereto and made a
part hereof, which are necessary to preserve the public health,
safety, and general welfare in the area.

Exhibit "A"
Conditions of Approval for Variance No. 275
and Extreme Slope No. 25
1. A Covenant to Protect Views shall be completed, notarized,
and submitted prior to issuance of building permits.
2. The maximum height of the attached deck shall not exceed 16
feet as measured from adjacent grade to the top of the rail.
3. The applicant shall landscape the base of the attached deck
on all sides to screen the proposed wood panel siding.
4. The maximum height of any proposed walls (garden, planters)
shall not exceed 42".
5. The maximum height of the trellis covering for the planters
and deck at the lower portion of the lot shall not exceed 12
feet.
6. The applicant shall landscape the entire east side of the
"covered garden/covered deck" to screen these structures.
7. A landscape plan shall be submitted to the Environmental
Services Department for review.
8. No grading has been approved with this request.
