PC RES 1990-067P.C. RESOLUTION NO. 90- 67 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DENYING THE APPEAL OF HEIGHT VARIATION NO. 642 THEREBY DENYING THE PROJECT AT 6921 LARKVALE. WHEREAS, the applicants, John and Janey Poorman have requested a Height Variation to allow a second story addition at a proposed height of 22'-6", measured pursuant to section 17.02.040 of the Development Code, at 6921 Larkvale; and WHEREAS, on September 10, 1990, the Director of Environmental Services denied Height Variation No. 642 for a two story addition at 6921 Larkvale; and WHEREAS, on September 18, 1990, Mr. and Mrs. Poorman filed an appeal to the Planning Commission within 15 days of the decision of the Director of Environmental Services; and WHEREAS, after notice pursuant to the City's Development Code, a public hearing was held on December 11, 1990, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: That pursuant to Section 17.02.040 of the Development Code guidelines, the applicants have complied with the provisions set forth for early neighborhood consultation, in that they discussed the proposed project with the neighbors within the vicinity and written notice of the application was mailed to the area's Home Owner's Association and to the residences above the subject addition who have been identified as the interested parties for this application. Nineteen of these 97 notices were returned and two residents in the area responded with letters of concern. Section 2: That the applicant constructed a temporary space frame of the outline of the proposed addition on September 1, 1989, the height and location of which were verified by Staff. Section 3: That the structure does not significantly impair a the view or vista from public property (parks, major thoroughfare, bikeway, walkway, equestrian trial etc.) which has been identified in the City's General Plan, Coastal Specific Plan or City -approved viewing area. Section 4: That the proposed structure is not located on a ridge or promontory. Section 5: That there is no significant cumulative impact caused by granting the application since the proposed project would not be seen from the protected primary viewing areas of any other property than at 28285 Trailriders. Section 6: That the proposed structure has not been designed and situated in such a manner as to minimize view obstruction since the 22'-6" addition would extend from south to north over almost the entire residence. The view of the ocean from 28285 Trailriders would be completely eliminated by the portion of the addition over 161. Section 7: That based upon an analysis set forth in the accompanying staff reports, the portion of the proposed addition over 16 feet high, when considered exclusive of existing foliage, does significantly impair the primary view from the residence at 28285 Trailriders which has been identified as having a view over the subject property as set forth in the City's Development Code. Section 8: That based upon photographic analysis of the vicinity, the proposed structure would not be compatible In scale with the immediate neighborhood since the square footage of the proposed two story residence is 1000 square feet larger than any other two story home in Grandview. Section 9: That the proposed two story residence would not conform with the required front and side yard setbacks. Section 10: For the foregoing reasons and based on information and findings included in the staff report and evidence presented at the public hearing, the Planning Commission of the City of Rancho Palos Verdes hereby denies the appeal of Height Variation No. 642, thereby upholding Staff denial of a second story addition.
