A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF RANCHO PALOS VERDES APPROVING
VARIANCE NO. 274 TO ALLOW AFTER -THE -FACT
CONSTRUCTION OF A GARAGE EXTENSION 9 FEET
INTO THE FRONT SETBACK AND 11 FEET FROM
THE FRONT PROPERTY LINE AT PROPERTY
LOCATED AT 2123 SUMMERLAND.
WHEREAS, Manouk and Dee Kassabian have requested a Variance
for after -the -fact construction of a garage extension 9 feet into
the front setback and 11 feet from the front property line; and,
WHEREAS, after notice issued pursuant to the provisions of
the Rancho Palos Verdes Development Code, a public hearing was
held on December 11, 1990, at which time all interested parties
were given an opportunity to be heard and present evidence;
NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:
Section 1: That there are exceptional or extraordinary
circumstances or conditions applicable to the property which do
not apply generally to other properties in the same zoning
district, in that the subject lot is substandard in size when
compared to other lots within the same zoning district.
Section 2: That such a variance is necessary for the
preservation and enjoyment of a substantial property right of the
applicant, which right is possessed by other property owners under
like conditions in the same zoning district in that the garage
extension will allow for compliance with the City's Development
Code and will allow the applicant to park and store their vehicles
in the garage.
Section 3: That the granting of the Variance will not be
materially detrimental to the public welfare or injurious to the
property and improvements .in the area as 15 foot setbacks are
common and the extension does not significantly impair the view
from any surrounding property and because of the 12 foot right-of-
way in front of the property, over 20 feet of back-up area from
the garage to the street will remain.
Section 4: That the granting of the variance will not be
contrary to the objectives of the general plan or the policies and
requirements of the coastal specific plan because there is no
change in the land use proposed and construction of the garage
will encourage compliance with the City's Development Code. The
property is not located within the coastal zone.
Section 5: For the foregoing reasons and based on the
information and findings included in the staff report and records
of the proceedings, the Planning Commission hereby approves the

request for approval of Variance No. 274 to allow after -the -fact
construction of a garage extension 9 feet into the front setback
and 11 feet from the front property line subject to the conditions
of approval in Exhibit "A" which are necessary to protect the
public health, safety, and welfare.

EXHIBIT "A"
CONDITIONS OF APPROVAL
Variance No. 274
2123 Summerland

1. Prior to final inspection, the landowner shall install an
articulated "roll -up" style garage door with an automatic
opening device.
2. Prior to final inspection, the landowner shall submit a
Landscape and Irrigation plan for review and approval by the
Director of Environmental Services. The landscape plan shall
incorporate a minimum of 80 percent drought tolerant planting
materials. The irrigation plan shall provide for separate
drip or bubbler irrigation systems for all high water use
areas and for trees.
3. Landowner and their representative shall comply with all
recommendations, if any, of the Division of Building and
Safety.
