P.C. RESOLUTION NO. 90- 65
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF RANCHO PALOS VERDES APPROVING VARIANCE
NO. 273 AND GRADING NO. 1491 AT 2727 COLT ROAD.
WHEREAS, Mr. and Mrs. Peter Mitilineos have requested a
Variance to allow a 3 story single family residence greater than
26 feet in height from a level building pad; and
WHEREAS, the applicant has requested grading for a structural
and freestanding wall greater than 3 feet in height within an
extreme slope to provide a slightly larger pad area for the
residence; and
WHEREAS, the applicant requests a reduction in the front
setback for a lattice cover greater than 42" within the required
front setback; and
WHEREAS, after notice issued pursuant to the provisions of
the Rancho Palos Verdes Development Code, a public hearing was
held on November 27, 1990, at which time all interested parties
were given an opportunity to be heard and present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: That there are exceptional and extraordinary
circumstances and conditions applicable to the property which
do not apply generally to other properties in the same zoning
district, in that there are difficult topographic and soils/
geologic conditions, such as the building pad being surrounded by
extreme slopes, adverse soils conditions and hazardous zoning
designations, and the building pad being substantially below Colt
Road, requiring the applicant to propose construction on a limited
building footprint. Construction toward the front of the lot will
help mitigate possible negative impacts to the extreme slope at
the north of the site, minor grading for development within an
extreme slope provides a slightly larger pad area for the
residence and a third story will allow reasonable living area.
Section 2: That approval for grading within an extreme
slope, a reduction in the front setback for improvements and a
height exceeding 26 feet is necessary for the preservation and
enjoyment of a substantial property right of the landowner as it
would insure that the residence is constructed entirely on the
level pad away from the extreme slope to the north since the pad
area of the residence is limited to a confined area in order to
control the impacts caused by construction on the site.
Section 3: That the granting of the Variance would not be
materially detrimental or injurious to properties in the area as
these improvements would be constructed against the slope and
would not be visible to any other property in the area. There
would be only minor change to the existing natural contours and
thus would not have a significant adverse affect on the visual
relationship with, nor the views from neighboring sites.
Section 4: That the development would be in conformance with
the General Plan since the mass of the structure would be set
against the hillside and not adversely impact views down the Colt
Canyon view corridor identified in Figure 41 of the General Plan.
Section 5: That Staff can make the necessary findings to
approve the development since the total grading for the proposed
project has been designed to minimize the disturbance to the
existing slopes.
Section 6: For the foregoing reasons, and based on
information and findings included in the staff report and
evidence presented at the public hearing, the Planning Commission
of the City of Rancho Palos Verdes hereby approves Variance No.
273 and Grading No. 1491, for grading within an extreme slope,
reduction in the front setback for a lattice cover greater than
42" and for a 3 story single family residence to exceed the 26
foot height limit allowed for a house constructed on a pad at a
different level than the street, subject to conditions hereto
attached as Exhibit "A".

VARIANCE NO. 273 and GRADING NO. 1491
2727 COLT ROAD
1. Maximum 7'-6" high structural retaining wall with 10.5 cubic
yards cut approved for the construction of a retaining wall
within the extreme slope on north west side of the residence
for a portion of the residence. Maximum 6' high wall to
replace the existing 6' high block wall along the toe of the
front yard slope.
2. An encroachment into the front setback is approved for the
lattice over 42 inches in height.
3. The applicant shall redraw the plans prior to issuance of
Planning Clearance to eliminate the portion of the residence
in excess of 36 feet as measured from the level of the pad.
4. A City Landscape Covenant to maintain property to protect
views shall be submitted to be recorded prior to issuance of
Building Permits.
5. The property owner shall submit a Hold Harmless with Geology
agreement prior to permit issuance.
6. The property owner shall install a holding tank and abandon
the leech field and septic system used in the vicinity.
7. There shall be no storage of materials, dumpsters etc. in the
improved right of way during construction of subject
residence.
8. A drought tolerant landscaping and irrigation plan shall be
submitted to and approved by the Director of Environmental
Services prior to final inspection.
9. The property owner shall confer with Staff representatives for
the Trails Committee and Public Works regarding dedicating a
trails easement for the Louise Trail prior to building permit
issuance.
10. The maid's room shall be redesigned to exclude the outside
entrance or a Second Unit Covenant shall be recorded prior to
permit issuance.
