P.C. RESOLUTION NO. 90- 64
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF RANCHO PALOS VERDES UPHOLDING THE APPEAL
OF HEIGHT VARIATION NO. 674 AT 6934 BROOKFORD DR. ,
THEREBY DENYING THE APPLICATION.
WHEREAS, the applicant, Mrs. Joyce Gibson has requested a
Height Variation to allow a second story addition at a proposed
height of 22' -10" , measured pursuant to section 17.02.040 of the
Development Code, at 6934 Brookford; and
WHEREAS, on August 3, 1990, notification of the Director of
Environmental Services' decision to approve Height Variation No.
674; and
WHEREAS, on August 21, 1990, after a 15 appeal period, in
which no appeal was filed, a "Planning Clearance" was issued to
the applicant; and
WHEREAS, on October 16, 1990, Mrs. Ann Stone addressed the
City Council with a request to file an appeal to the Planning
Commission stating the "interested parties" had not received the
August 3, 1990 notification and were denied their right to appeal ;
and
WHEREAS, since a building permit has not been obtained and
work has not commenced, the right to an appeal was granted; and
WHEREAS, on October 18, 1990, Ms. Ann Stone ( 28125 Ambergate)
appealed the Director' s decision to the Planning Commission; and
WHEREAS, after notice pursuant to the City' s Development
Code, a public hearing was held on November 27 , 1990, at which
time all interested parties were given an opportunity to be heard
and present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: That pursuant to Section 17.02.040 of the
Development Code and adopted guidelines, the applicants have
complied with the provisions set forth for early neighborhood
consultation, in that they discussed the proposed project with the
neighbors within the vicinity and there is no Homeowner' s
Association for this area to notify.
Section 2: That the applicant constructed a temporary space
frame of the outline of the proposed addition on March 23, 1990,
the height and location of which were verified by Staff.
Section 3: That the structure does not significantly impair
a the view or vista from public property (parks, major
thoroughfare, bikeway, walkway, equestrian trial etc.) which has
been identified in the City's General Plan, Coastal Specific Plan
or City -approved viewing area.
Section 4: That the proposed structure is not located on a
ridge or promontory.
Section 5: That the proposed structure has been designed and
situated in such a manner as to minimize view obstruction since
the 22'-10" addition would extend only over the front of the
residence. The proposed two story residence would conform with
the required front and side yard setbacks.
Section 6: That the proposed structure, when considered
exclusive of existing foliage, does impair a view from the viewing
areas of the residences at 28125 and 28133 Ambergate which have
been identified as having a view over the subject property as set
forth in the City's Development Code.
Section 7: That there would be significant cumulative impact
caused by granting the application since there would be an
incremental loss of views if subsequent second story additions,
situated in a similar manner and at a similar height were
approved.
Section 8: That based on an analysis of the surrounding
vicinity, the proposed structure is not compatible with the
character of the immediate neighborhood in that the proposed
second story addition will appear significantly more massive in
terms of size and scale, when compared to the existing residences,
particularly due to the placement of the structure at the front of
the property.
Section 9: For the foregoing reasons and based on
information and findings included in the Staff report and evidence
presented at the public hearing, the Planning Commission of the
City of Rancho Palos Verdes hereby upholds the appeal of Height
Variation No. 674, thereby denying the request for a second story
addition at 6934 Brookford Drive.
