RESOLUTION NO. 90 - 60 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING CONDITIONAL USE PERMIT NO. 160 FOR THE CONSTRUCTION OF A CUPOLA/MAST AND APPROVING SIGN PERMIT NO. 536 ALLOWING TWO WALL SIGNS ON THE SIDES OF THE BUILDING, REQUIRING THE REMOVAL OF THE EXISTING POLE SIGN AT 28902 WESTERN AVENUE. WHEREAS, Dr. Michael McGowan and Bay Cities National Bank have requested approval of Conditional Use Permit No. 160 and Sign Permit No. 536 to allow the construction of cupola and mast and 2 wall signs on the buildings at 28902 S. Western Avenue. WHEREAS, after notice pursuant to the Development Code, a public hearing was held on November 13, 1990 at which time all interested parties were given the opportunity to give testimony and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: That the granting of the Conditional Use Permit will not be contrary to the objectives of the General Plan in the proposed site plan and related uses comply with the General Plan and zoning land use designations. Section 2: That the subject site is adequate in size and shape to accommodate the intended use, subject to the conditions of approval contained in Exhibit "A", attached hereto. Section 3: That the site is serviced by Western Avenue whose traffic capacity is adequate to serve the site and subject use without suffering significant impacts to its level of service. Section 4: That the subject use will cause no significant adverse effect on adjacent property of the permitted use thereof, due to conditions of approval contained in Exhibit "A", attached hereto, which include deletion of structures which minimizes view impacts. Section 5: That the existing pole sign is not necessary for the applicant's enjoyment of substantial trade, since the existing/approved building signs are highly visible to traffic on Western Avenue. Section 6: That the proposed construction of the cupola and mast and two wall signs at the sides of the building are consistent with the requirements of Sections 17.52.065 and 17.16.030 of the Development Code. i LI Section 7: For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes does hereby approve Conditional Use Permit No. 160 and approve Sign Permit No. 536 subject to the conditions contained in Exhibit "A", attached hereto and made a part hereof, which are necessary to preserve the public health, safety, general welfare in the area. Resolution No. 90-60' Page 2 111 411 EXHIBIT "A" CONDITIONAL USE PERMIT NO. 160 SIGN PERMIT NO. 536 1. The site and building plan dated September 10, 1990 shall be approved for the cupola with weather vane and mast. The mast shall not be used to fly flags of a commercial nature. 2. The sign plan dated September 10, 1990 shall be approved for the two wall signs proposed at the north and south sides of the building. 3. The existing pole sign shall be removed prior to issuance of occupancy permit or installation of permanent signage, whichever comes first. 4. This approval shall expire within 1 year after the date of approval if a building permit is not obtained for Conditional Use Permit No. 160. P.C. Resolution No. 90-60 Page 3
