RESOLUTION NO. 90-59 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES SUSTAINING THE APPEAL OF HEIGHT VARIATION NO. 684 THEREBY APPROVING THE PROJECT AT 3300 PALOS VERDES DRIVE EAST. WHEREAS, on August 21, 1990, the Director of Environmental Services denied Height Variation No. 684 for a two story addition to a maximum height of 23'4" at 3300 Palos Verdes Drive East; and WHEREAS, on August 29, 1990, the applicants, Mr. and Mrs. Jerald Farrell filed an appeal of the Director's decision to the Planning Commission within 15 days of the decision of the Director of Environmental Services; and WHEREAS, after notice pursuant to the City's Development Code, the Planning Commission held a public hearing on October 9, 1990, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: That pursuant to Section 17.02.040 of the Development Gode guidelines, the applicant has complied with the provisions for early neighborhood consultation, in that they have discussed the proposed project with 89 percent of the 38 properties located within 500 feet of the property including representatives of the Palos Verdes Unified School District and the Palos Verdes Library District and written notice of the application was mailed to the 38 properties within a 500 foot radius of the site on July 13, 1990 with 1 of the notices being returned. Section 2: That the applicant constructed a temporary space frame of the outline of the proposed addition, the height and location of which were verified by staff. Section 3: That the structure does not significantly impairt a view or visa from public property (parks, major thoroughfare, bikeway, walkway, equestrian trial, etc.) which has been identified in the City's General Plan, Coastal Specific Plan, or City -approved viewing area in that the Vista identified by Staff is not adjacent to the property, that the view down the adjacent canyon will not be impaired by the proposed structure, and that removal of trees located both on the applicant's and City property will mitigate any loss of views of the Los Angeles Harbor and Vincent Thomas Bridge as viewed from the Vehicular Corridor. Section 4: That the proposed structure is not located on a ridge or promontory. Section 5: That the proposed structure is designed and situated in such a manner as to minimize view obstruction in that views down the adjacent canyon will be maintained and trees located both on the applicant's and City property will be removed to open views not currently existing and mitigate further view obstruction which may be caused by the structure. Section 6: That there would not be significant cumulative impact caused by granting the application in that due to the unique topography and location of the proposed structure, there are no other properties in the immediate vicinity which would cause view impairment if construction similar to that proposed were to occur. Section 7: That the portion of the proposed addition over 16 feet in height, when considered exclusive of existing foliage, does not significantly impair the view from the viewing area of other properties. Section 8: That based upon analysis of structures in the vicinity, the proposed structure is compatible with the character of the immediate neighborhood with respect to required setbacks and the architectural style and materials are consistent with the surrounding neighborhood. Section 9: For the foregoing reasons and based on information and findings included in the staff report, and evidence presented at the public hearing, the Planning Commission hereby sustains the appeal of Height Variation No. 684, thereby approving the project and overturning the Director of Environmental Services' decision to deny the second story addition, subject to the conditions of approval in Exhibit "A" which are necessary to protect the public health, safety, and welfare. Resolution No. 90-59 Page 2 EXHIBIT "A" CONDITIONS OF APPROVAL HEIGHT VARIATION NO. 684 3300 PALOS VERDES DRIVE EAST 1. Landowner shall submit to the City a Covenant to Maintain Property to protect views prior to issuance of building permits. 2. Prior to issuance of building permits, landowner shall remove and trim trees located on the property and within the right- of-way adjacent to the property which have been identified in the November 13, 1990 addendum to the Staff Report as amended at the Planning Commission meeting. 3. Maximum height of the structure shall not exceed 23'4". 4. Prior to final building permits, the landowner shall submit for approval by the Director of Environmental Services a Landscape and Irrigation plan. The Landscape planting plan shall include a minimum of 80% drought tolerant species. The Irrigation plan shall provide for separate drip irrigation systems for all high water use areas and for irrigation of all trees. Selected tree species shall be of a type that can be maintained not to exceed 16 feet in height. P.C. Resolution No. 90-59 Page 3
