A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF RANCHO PALOS VERDES APPROVING
VARIANCE NO. 271 AND GRADING NO. 1458 TO
ALLOW CONSTRUCTION OF A GARAGE AND NEW
RETAINING WALL INTO AN EXTREME SLOPE AT
PROPERTY LOCATED AT 2104 VELEZ DRIVE.
WHEREAS, Roy and Norma Nakamura have requested a
Variance and a Grading Permit for construction of a garage
and new retaining wall into an extreme slope; and
WHEREAS, after notice issued pursuant to the provisions
of the Rancho Palos Verdes Development Code, a public hearing
was held on October 23, 1990, at which time all interested
parties were given an opportunity to be heard and present
evidence;

NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE
AS FOLLOWS:
Section 1: That the grading is not excessive beyond that
necessary for the permitted use of the lot in that
construction of the new retaining wall will require only 21
cubic yards of cut.
Section 2: That the grading and/or construction does not
significantly adversely affect the visual relationships with,
nor the views from, neighboring sites in that the proposed
addition will not exceed 16 feet in height.
Section 3: That there are exceptional or extraordinary
circumstances or conditions applicable to the property which
do not apply generally to other properties in the same zoning
district, in that transitional slopes and the size of the lot
limit available area in which to construct a garage so as not
to encroach into the extreme slope and required sideyard
setback for sloping lots.
Section 4: That such a variance is necessary for the
preservation and enjoyment of a substantial property right of
the applicant, which right is possessed by other property
owners under like conditions in the same zoning district in
that most of the other properties in the immediate
neighborhood have enclosed two car garages on the property
and that the granting of this variance will restore a
substantial property right which is possessed by other
property owners in the same zoning district.
Section 5: That the granting of the variance will not be
materially detrimental to the public welfare or injurious to

the property and improvements in the area in which the
property is located in that the applicant and all their
representatives shall comply with all recommendations, if
any, of the Division of Building and Safety.
Section 6s That the granting of such a variance will not
be contrary to the objectives of the general plan or the
policies and requirements of the coastal specific plan
because there is no change in the land use proposed and
construction of the garage will encourage compliance with the
Development Code. The property is not located within the
coastal zone.
Section 7: For the foregoing reasons and based on the
information and findings included in the staff report and
records of the proceedings, the Planning Commission hereby
approves the request for approval of Variance No. 271 and
Grading Permit No. 1458 to allow construction of a garage and
new retaining wall into an extreme slope subject to the
conditions of approval in Exhibit "A" which are necessary to
protect the public health, safety, and welfare.

Variance No. 271, Grading Permit No. 1458
2104 Velez Drive
1 . Laidowner shall submit to the City a Covenant to
Maintain Property to protect views prior to issuance of
building permits.
2. Landowner and their representative shall comply with all
recommendations, if any, of the Division of Building and
Safety.
3. The plans shall be revised so that no portion of the new
retaining wall exceeds 42 inches in height.
4. Maximum height of the addition shall not exceed 16 feet.
