A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF RANCHO PALOS VERDES APPROVING PORTIONS OF
ENCROACHMENT PERMIT NO. 18 AT 6400 CORSINI PLACE.
WHEREAS, on August 14, 1990, the Planning Commission
accepted only the following portions of the applicant's
requested improvements within the public right-of-way:
1) The resurfacing of the existing circular driveway.
2) Six foot (6'-0") high wrought -iron fencing and concrete
pilasters up to, but not including, any construction
within the intersection visibility triangle as designated
on the approved set of plans.
3) The southern -most set of gates (not to exceed a height of
6'-0") to allow access onto the property from Corsini P1.
4) A landscaping and irrigation plan must be submitted and
reviewed prior to final approval of any landscaping.
and continued the item so that the applicant and Staff could
resolve the remaining issues; and
WHEREAS, after notice pursuant to the City's Development
Code, the Planning Commission held a public hearing on
September 25, 1990, at which time all interested parties were
given an opportunity to be heard and present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE
AS FOLLOWS:
Section 1: That the granting of the approved portions of
Encroachment Permit No. 18 is in the best interest of the
City because the improvements to occur within the right-of-
way will visually enhance this area of the City at the
expense of the applicant.
Section 2: That the granting of the approved portions of
Encroachment Permit No. 18 is not detrimental to public
health and safety since the improvements will not occur
within the intersection visibility triangle.
Section 3: That the granting of the approved portions of
Encroachment Permit No. 18 is necessary since there is no
alternative location on the applicant's property for the
improvements to eliminate the need to encroach.

Section 4: For the foregoing reasons and based on the
information and findings included in the Staff report,
minutes, and evidence presented at the public hearing, the
Planning Commission hereby approves portions of the
applicant' s requests, subject to the conditions outlined in
the attached Exhibit "A" .

EXHIBIT "A"
ENCROACHMENT PERMIT NO. 18
CONDITIONS OF APPROVAL
1. Only the following improvements have been approved with
this application:
A. The resurfacing of the existing circular driveway.
B. Six foot (6' -0" ) high wrought-iron fencing with
6'-0" concrete pilasters up to, but not including,
any construction within the intersection
visibility triangle as designated on the approved
set of plans.
C. The southern-most set of gates (not to exceed a
height of 6' -0" ) to allow access onto the property
from Corsini Place.
D. A landscaping and irrigation plan (for the area
adjacent to Corsini P1 . only) must be submitted
and reviewed prior to final approval of any
landscaping.
2.a. The owner must provide a hold harmless agreement.
b. The owner must agree to remove the encroachment at the
direction of the Public Works Director on ten (10) days
notice except in an emergency situation where removal
may be required on shorter notice. If the owner fails
to remove the encroachment within the specified time,
the City will do the work and the owner will be billed.
c. The owner must obtain liability insurance ($500,000 -
$1,000, 000) , naming the City as additional insured, and
provide a copy of said insurance policy annually.
d. The owner must record the above conditions as conditions
running with the land to the satisfaction of the City
Attorney. The owner must obtain formal Encroachment
Permit from the Public Works Department.
e. The encroachment must be constructed, installed, and
maintained in accordance with approved plans and
conditions.
