PC RES 1990-049P.C. RESOLUTION NO. 90-49 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING VARIANCE NO. 264 TO ALLOW CONSTRUCTION OF A CIRCULAR DRIVEWAY AND PARKING AREA WHICH WILL COVER MORE THAN FIFTY (50) PERCENT OF THE REQUIRED FRONT YARD SETBACK AT PROPERTY LOCATED AT 4200 PALOS VERDES DRIVE EAST. WHEREAS, George and Marilyn Dalton have requested a Variance for construction of a circular driveway and parking area to cover more than fifty (50) percent of the required front yard setback; and WHEREAS, after notice issued pursuant to the provisions of the Rancho Palos Verdes Development Code, a public hearing was held on September 11, 1990, at which time all interested parties were given an opportunity to be heard and present evidence; NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: That there are exceptional or extraordinary circumstances or conditions applicable to the property which do not apply generally to other properties in the same zoning district, since the property is located on a very narrow and heavily travelled portion of Palos Verdes Drive East and the owners are subject to fast moving traffic in front of their residence. Section 2: That such a variance is necessary for the preservation and enjoyment of a substantial property right of the applicant, which right is possessed by other property owners under like conditions in the same zoning district in that six of the eight neighboring properties subject to similar traffic patterns have driveway and parking areas which cover more than fifty (50) percent of the required front setback. Section 3: That the granting of the variance will not be materially detrimental to the public welfare or injurious to the property and improvements in the area in which the property is located in that the proposed driveway will improve access to and from the subject property and provide for less hazardous conditions because the owners will not have to back into the traffic lanes from their driveway. Section 4: That the granting of such a variance will not be contrary to the objectives of the general plan or the policies and requirements of the coastal specific plan in that no change in the land use is proposed and the project site is not located within the coastal zone. Section 5: For the foregoing reasons and based on the information and findings included in the staff report, minutes, and the records of proceedings, the Planning Commission hereby approves the request for approval of Variance No. 264 to allow construction of a circular driveway and parking area which will cover more than fifty (50) percent of the required front yard setback subject to the conditions of approval in Exhibit "A" which are necessary to protect the public health, safety, and welfare. Resolution No. g0- 49 Page 2 EXHIBIT "A" Conditions of Approval Variance No. 264 4200 Palos Verdes Drive East 1. Landowner shall submit to the City a Covenant to Maintain Property to protect views prior to issuance of building permits. 2. The plans as submitted shall be revised so that the maximum combined height of the retaining wall and wall above shall not exceed 8 feet in height as measured from the grade on the lower side and 6 feet in height as measured from the grade on the higher side. 3. No grading or construction is permitted in the extreme slope areas (350 or greater). 4. This project requires review and approval by the Department of Public Works. The landowner and his/her representative shall comply with all recommendations, if any, required by the Department of Public Works. 5. The landowner or his/her representative shall coordinate with the Department of Public Works for traffic control and access during construction. 6. Haul routes require review and approval by the Divisions of Building and Safety and Planning. 7. The applicant is encouraged to locate and use fill material excavated from other approved grading projects in the vicinity. 8. Fencing shall be provided around two existing Italian Stone Pines (Pinus pinea); one located to the north of the property and one located directly in front of the residence on Palos Verdes Drive East to protect the trees from damage during construction.
