PC RES 1990-047P.C. RESOLUTION NO. 90-47 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING VARIANCE NO. 268 TO ALLOW A DECK MORE THAN SIX FEET OVER AN EXTREME SLOPE. WHEREAS, Ms. Becky Salzetti has requested a Variance to allow a 382 square foot deck extending more than six feet over an extreme slope at her property located at 27508 Elmbridge Drive; and WHEREAS, after notice issued pursuant to the Rancho Palos Verdes Municipal Code, a public hearing was held on August 28, 1990, at which time all interested parties were given an opportunity to be heard and present evidence; and NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: That there are exceptional and extraordinary circumstances or conditions applicable to the property whish do not apply generally to other properties in the same zoning district, specifically, steep topography on much of the lot which prevents the use of much of the property. Section 2: That the Variance is necessary for the preservation and enjoyment of a substantial property right of the landowner, since the deck enhances the use of the property. Section 3: That granting of the Variance will not be materially detrimental to the public health, safety, and welfare, since the proposed improvements to the property do not and would not adversely impact the privacy or views of the surrounding properties. Section 4: That granting of the Variance will not be contrary to provisions of the General Plan, since the use will remain single-family residential. • Section 5: That for the foregoing reasons and based on information and findings included in the staff report and evidence presented at the public hearings, the Planning Commission of the City of Rancho Palos Verdes hereby approves Variance No. 268 subject to the conditions marked in Exhibit "A" which are necessary to protect the public health, safety, and general welfare of the area. Resolution No. 90-47 Page 2 Variance No. 268 27508 Elmbridge 1. A City Covenant to Maintain Property to Protect Views shall be submitted to be recorded prior to issuance of building permits. 2. A hedge of myoporum or similar suitable landscape material shall be planted between the deck and the property line, common to the subject property and 27502 Elmbridge, for the purpose of visually screening the deck from view of that property. 3. Vegetation shall be planted along the remaining two sides of the deck for the purpose of softening the deck's visual impact on neighboring properties. P.C. Resolution No. 90-47 Page 3
