PC RES 1990-046P.C. RESOLUTION NO. 90-46 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING VARIANCE NO. 26`6 AND GRADING APPLICATION NO. 1412 TO ALLOW AN EXISTING RETAINING WALL AND DECORATIVE PILASTERS TO REMAIN AT 40 SANTA BARBARA. WHEREAS, Dr. John Furesh submitted Grading Application No. 1412 on February 16, 1990, and Variance Application No. 266 on June 25, 1990, allow a 416" maximum height retaining wall and two 5'6" decorative pilasters to exceed the 42" height limit within the front yard setback. WHEREAS, on August 28, 1990, the Planning Commission held a public hearing to consider this request at which time all interested parties were invited to attend and give testimony. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY RESOLVE: Section 1: That there are exceptional circumstances and conditions applicable to the property which do not apply generally to other properties in the same zoning district, in that the subject property was developed as a split level lot due to pre- existing topography. The retaining wall was built to retain the pre-existing contours of the front yard and to protect against erosion and runoff onto the driveway. Section 2: That the Variance is necessary for the preservation and enjoyment of a substantial property right of the landowner in that there exist other properties within the residential tract which contain decorative walls and pilasters with lights which exceed 42" in the front setback. Section 3: That the granting of the Variance will not be materially detrimental to the public health, safety, and welfare since the existing retaining wall and pilasters will not adversely impact the privacy, views, or property values of surrounding properties. Section 4: That the existing retaining wall and pilasters are in conformance with the General Plan as residential densities are preserved, views are protected and the residential neighborhood is improved. • • Section 5: For the foregoing reasons, the Planning Commission hereby approves Variance No. 244 and Grading Permit No. 1412.
