PC RES 1990-044P.C. RESOLUTION NO. 90-44 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING GRADING APPLICATION NO. 1410 AT 6200 VIA CANADA. WHEREAS, Nuel Benson has requested a Grading permit to construct a single family residence on a lot with an overall average slope greater than 35 percent. WHEREAS, after notice pursuant to the City's Development Code, a hearing was held on August 14, 1990, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: That based on information submitted, on-site verification, and reports reviewed by the City's geologist that the open space hazard zoning designation has been precisely determined by the Director of Environmental Services and that the proposed development will occur on portions of the lot zoned RS -2 with slopes less than 35 percent. Section 2: That the grading indicated is not excessive beyond that necessary for the primary permitted use of the lot since the plans will allow for a residential structure of approximately 3,811 square feet which is consistent in size with other residential structures in the immediate neighborhood. Section 3: That the grading and construction do not adversely affect visual relationships with, nor the views from, neighboring sites since the proposed structure is within the allowable height requirements. Section 4: That the nature of the grading minimizes disturbance to the natural contours; finished contours are reasonably natural since the structure will step with the slope and the maximum height of one downslope and one side yard retaining walls will not exceed 42 inches in height. Section 5: For the foregoing reasons and based on the information and findings included in the staff report, minutes, and records of proceedings, the Planning Commission hereby approves the request for approval of Grading Permit No. 1410 to construct a single family residence on a lot with an average slope greater than 35 percent subject to modifications and the conditions of approval in Exhibit "A" which are necessary to protect the public health, safety, and welfare. The plans as submitted shall be revised to provide proper light and ventilation or other provisions as required by the Building Code to allow the "underfloor area" to be used as habitable area. 2. Maximum elevation of the structure shall not exceed 777.0 feet. Maximum upslope height of the structure shall not exceed 16' 0" and the maximum downslope height of the structure shall not exceed 30' 0" . 3. Maximum height of downslope and side yard retaining walls shall not exceed 42 inches. Maximum combined height of retaining walls and any fencing or railing placed above shall not exceed 6 feet on the high side and 8 feet on the low side. 4. Landowner shall submit to the City a Covenant to Maintain Property to protect views prior to issuance of building permits. 5. A landscape plan indicating plant species, size, and location and an irrigation plan shall be submitted for review and approval by the Director of Environmental Services prior to final inspection of the structure. The plans shall utilize a minimum of 80% drought tolerant material and fire retardant plant species where possible. The irrigation system shall provide for separate water lines for all high water use areas. Landscaped areas shall be limited to those areas with less than 35 percent slope. All other areas shall maintain the existing, natural vegetation. 6. No grading is permitted beyond the extreme slope ( 35 percent slope or greater) areas indicated on the plans. 7 . The landowner and their representative shall comply with all recommendations of the City geologist and with all recommendations, if any, of Building and Safety. 8. The hauling route used for the export of the soil material shall be reviewed and approved by the Directors of Environmental Services and Public Works. P.C. Resolution No . 90-44 Exhibit A
