A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF RANCHO PALOS VERDES APPROVING VARIANCE
NO. 263 TO ALLOW AN EXISTING DECK MORE THAN
SIX FEET OVER AN EXTREME SLOPE AND AN EXISTING
STRUCTURE IN THE SIDE -YARD SETBACK.
WHEREAS, Mr. Steve Vilicich has requested a Variance to allow
an existing 735 square foot sundeck extending more than six feet
over an extreme slope as well as an existing barbecue pit
structure built in the side setback located at 30306 Diamonte
Lane, and
WHEREAS, after notice issued pursuant to the Rancho Palos
Verdes Municipal Code, a public hearing was held on ,July 24, 1990,
at which time all interested parties were given an opportunity to
be heard and present evidence; and
WHEREAS, Mr. Steve Vilicich had been granted City approval
for and began construction of both the deck and barbecue pat;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:
Section 1: That there are exceptional and extraordinary
circumstances or conditions applicable to the property which do
not apply generally to other properties in the same zoning
district, specifically, steep topography on much of the lot
prevents the use of much of the property.
Section 2: That the Variance is necessary for the
preservation and enjoyment of a substantial property right of the
landowner, since the existing deck and barbecue enhances the use
of the property.
Section 3: That granting of the Variance will not be
materially detrimental to the public health, safety, and welfare,
since the existing and prosed improvements to the property do not
and would not adversely impact the privacy or views of the
surrounding properties.
Section 4: That for the foregoing reasons and based on
information and findings included in the staff report and evidence
presented at the public hearings, the Planning Commission of the
City of Rancho Palos Verdes hereby approves Variance No. 263
subject to the conditions marked in Exhibit "A" which are
necessary to protect the public health, safety, and general
welfare of the area.

Section 5 : For the foregoing reasons , the Planning
Commission of the City of Rancho Palos Verdes hereby approves
Variance No . 263 subject to the conditions of approval contained
in Exhibit "A" .
