A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF RANCHO PALOS VERDES APPROVING THE
EXTENSION OF SPECIAL USE PERMIT NO. 76, TO
ALLOW CONTINUED USE OF ROCK CRUSHING
EQUIPMENT DURING GRADING OPERATIONS AT TRACT
NO. 45667.
WHEREAS, on November 14, 1989, the Planning Commission
adopted P.C. Resolution No. 89-66, approving the use of rock
crushing equipment during grading operations at Tract No. 45667 on
Palos Verdes Drive South; and
WHEREAS, the conditions of approval limited the use to six
months from the commencement of grading activities, which began on
October 30, 1990, unless extensions are granted by the Director of
Environmental Services; and
WHEREAS, on April 13, 1990, the applicant requested extension
of Special Use Permit No. 76 through October 31, 1990; and
WHEREAS, on April 30, May 11, and May 23, 1990, the Director
of Environmental Services approved extensions to the permit, with
the final extension through June 26, 1990, and allowing no further
extension past that date; and
WHEREAS, on June 5, 1990, the applicant requested a hearing
before the Planning Commission to review the Director's decision
not to grant further extensions; and
WHEREAS, on June 26, 1990, the Planning Commission heard the
request, at which time all interested parties were given an
opportunity to be heard and to present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: That the site for the proposed use is adequate in
size and shape to accommodate said use, since grading activity
will be ongoing and a graded pad exists to support the rock
crushing equipment.
Section 2: That the site for the proposed use relates to
streets properly designed to carry the type and quantity of
traffic generated, since the grading approval included
requirements for a traffic safety and circulation plan, which has
been approved by the Public Works Department.
Section 3: That there will be no significant adverse effects
on adjacent property or the permitted use thereof, as the rock
crushing operation is incidental to the grading activity on the
tract, and conditions have been included to minimize noise and
dust impacts.
Section 4: That the extended use of the rockcrushing
equipment would minimize impacts on adjacent residents, since the
total length of the grading operation would be lessened and the
total number of truck trips required would be reduced.
Section 5: That extension of the proposed use is not
contrary to the general plan, since impacts are restricted to
levels prescribed by the plan.
Section 6: That the Planning Commission has reviewed and
considered the contents of the Negative Declaration for
Environmental Assessment No. 588, previously adopted on November
14, 1990, prior to acting on this project, and determined that
approval of the project will not result in a significant effect on
the environment.
Section 7: For the foregoing reasons and based on findings
included in the Staff Report and proceedings at the public
hearing, the Planning Commission of the City of Rancho Palos
Verdes does hereby approve an extension of Special Use Permit No.
76, subject to the attached conditions marked Exhibit "A" which
are necessary to protect the public health, safety and general
welfare.

SPECIAL USE PERMIT NO. 76 - EXTENSION
CONDITIONS OF APPROVAL
1. The continued use of rockcrushing equipment is permitted
through September 26, 1990. The Director of Environmental
Services may approve one two-week extension beyond that point
if he finds that such extension is necessary to expedite
completion of the project. No further extension of the
permit will be allowed.
2. The rockcrushing equipment may not operate until all of the
conditions outlined below are satisfied.
3. Within 5 working days of the approval of this extension, the
applicant must provide a signed letter agreeing to the
conditions outlined below, or the approval shall become null
and void.
4. The Director of Environmental Services or his designee may
prohibit operation of the equipment at any time upon
determination that one or more of the conditions of this
approval are not being met. Additionally, the Director, with
the approval of the City Manager, may require the applicant
to reimburse the City for the costs of providing personnel to
monitor dust control and/or other conditions of approval.
5. All of the conditions of the original approval, as listed in
Exhibit "A" of P.C. Resolution No. 89-66, continue to apply
during the extension period.
6. The noise attenuation barrier must remain in place and shall
be extended horizontally, as determined by the Director of
Environmental Services, to further screen the equipment and
to limit dust. In addition, a bag or chute shall be
installed over the endpoint of the conveyor to reduce dust at
that point.
7. All crushed rock shall be removed within two days of being
stockpiled, and in no case shall piles, other than the active
pile, be allowed to exceed ten feet in height, and shall not
exceed 50 feet in width (facing Palos Verdes Drive South),
and shall not exceed a total of 1,800 cubic yards (two days
production). Any crushed rock in excess of four feet in
height left over a weekend shall be covered to control dust.
8. Watering of the rockcrushing equipment shall be maintained to
control dust.
9. Methods shall be implemented at the point of loading haul
trucks, for dirt as well as rock, to water the material prior
to and/or during loading into the truck and into sifting

equipment. Methods shall be approved by the :Director of
Environmental Services and may include hand-held watering at
the point of loading or mechanical scaffolding adjacent to
the trucks.
10. All finished grading on the site should be expeditiously
stabilized through hydroseeding, emulsifiers, etc. to cover
exposed dirt.
11. Additional watering trucks shall be provided to allow for
watering exposed, unplanted areas at least once per hour on
areas not being graded, and at least once per 30 minutes for
equipment access routes and areas being graded. More
frequent watering may be required if necessary to control
dust, particularly during windy periods.
12. The site shall be watered thoroughly immediately prior to
closing the site each day, and the site shall be watered on
days on which no work occurs, except on Sundays and holidays.
13. The applicant shall communicate with neighboring residents on
at least a bi-weekly basis, through meetings, newsletters,
etc., and provide an update of the project status and
information regarding who to contact regarding questions or
concerns.
14. All rockcrushZng, grading, and trucking shall cease on days
where unusual weather conditions exist which may exacerbate
impacts, including but not limited to first stage smog alerts
in the South Bay area, high winds, and/or high temperatures.
