PC RES 1990-034P.C. RESOLUTION NO. 90-34 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING VARIANCE NO. 265 SUBJECT TO CONDITIONS AND MODIFICATIONS REQUIRING A 6 FOOT SOLID WALL AND GATED ENTRANCE ARCADE ALONG THE STREET SIDE AND FRONT YARD PROPERTY LINES AT 6401 CORSINI PLACE WHEREAS, Richard and Maria Higgins have requested a Variance for a solid freestanding wall and gated entrance arcade to exceed 42" along the front and street side yard property lines; and WHEREAS, after notice issued pursuant to the provisions of the Rancho Palos Verdes Development Code, a public hearing was held, at which time all interested parties were given an opportunity to be heard and present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: That there are special circumstances related to the size, shape, and topography of the property which are not generally found on other lots in the same zoning district, in that a portion of the front and street side yards of the lot abut two streets of access; one of the streets being a major thoroughfare. Section 2: That the Variance is necessary for the preservation and enjoyment of a substantial property right of the landowner, since the configuration and orientation of the residence in relationship to the property lines and streets of access do not allow reasonable privacy and safety from noise and traffic along Palos Verdes Drive East; Section 3: That granting of the Variance will not be materially detrimental to the public health, safety, and welfare since the improvement made to the property does not adversely impact the privacy or primary views of surrounding properties and it will be screened from the public right of way by foliage; and Section 4: That the proposed development is in conformance with the General Plan since the height of the wall will provide the property owner with additional privacy and reduced noise from traffic. Section 5: For the foregoing reasons, and based on information and findings included in the staff report, minutes, and evidence presented at the public hearing, the Planning Commission hereby approves Variance No. 265 subject to the conditions of approval in Exhibit "A" . Resolution No. 90-34 Page 2 111 111 EXHIBIT "A" Variance No. 265 6401 Corsini Place 1 . Maximum height of the wall and gated entrance arcade shall not exceed 6' -0" . Design and articulation details shall be submitted to the Department of Environmental Services for review and approval . 2 . The portion of the wall facing Palos Verdes Drive East shall be properly screened with vegetation. 3 .
