P.C. RESOLUTION NO. 90-30
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF RANCHO PALOS VERDES APPROVING VARIANCE NO. 258 TO
ALLOW A 528 DETACHED GARAGE TO ENCROACH INTO THE
REQUIRED FRONT SETBACK LOCATED AT 28 NARCISSA.
WHEREAS , Mr. and Mrs. Larry Horan have requested a Variance
for a 528 square foot detached garage to encroach 15 feet into the
front yard setback; and
WHEREAS , after notice issued pursuant to the provisions of
the Rancho Palos Verdes Development Code , a public hearing was
held on June 12 , 1990 , at which time all interested parties were
given an opportunity to be heard and present evidence ;
NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS :
Section 1 : That there are exceptional or extraordinary
circumstances or conditions applicable to the property which do
not apply generally to other properties in the same zoning
district , since the proposed building site is located within the
Landslide Moratorium area and there are fissures which traverse
the property which restrict the feasible garage locations to areas
within the front setback.
Section 2 : That the Variance is necessary for the
preservation and enjoyment of a substantial property right of the
landowner, in that the existing garage has been previously
damaged by earth movement and by permitting the new garage in the
proposed location a substantial property right of the landowner
will be restored, and the property will then be in compliance with
Development Code standards with regards to garages .
Section 3 : That the granting of the Variance will not be
materially detrimental to the public welfare or injurious to
property and improvements in the area in which the property is
located since the proposed structure will be a minimum of 20 feet
from the edge of the existing improved roadway.
Section 4 : That the proposed development is in conformance
with the General Plan as residential densities are preserved,
adequate off-street parking is provided, and views from adjacent
properties will not be impaired.

Section 5 : For the foregoing reasons and based on the
information and findings included in the staff report , minutes ,
and records of proceedings , the Planning Commission hereby
approves the request for approval of Variance No . 258 to allow a
528 square foot detached garage to be constructed 15 feet within
the required front setback subject to the conditions of approval
in Exhibit "A" , which are necessary to protect the public health,
safety, and welfare .

1. The landowner shall submit to the City a Covenant to Maintain
Property to protect views prior to issuance of building
permits.
2. Maximum height of the detached garage shall not exceed 12'0".
3. Maximum height of the portion of the existing garage to be
converted to habitable space shall not exceed 16'0" as
measured from existing grade.
4. The plans as submitted shall be revised to reflect a
reduction in the eave projection on the new garage to 20
inches maximum (from 24 inches).
5. The proposed skylights shall be fixed to the roof subject to
the review of the Division of Building and Safety.
6. Geology study as submitted is subject to approval of the City
Geologist. Applicant shall comply with any recommendations
of the City Geologist prior to issuance of building permits.
7. The new detached garage shall be constructed without windows.
All water service and drainage shall be limited to minor
plumbing fixtures (no bathroom or kitchen facilities).
8. No new plumbing fixtures which involve additional water
usage, e.g., sinks, toilets, spas, pools, sprinklers, etc.,
shall be permitted in that portion of the existing garage
which is to be converted to habitable space.
9. Maximum allowable construction is limited to one 528 square
foot detached garage and conversion of 200 square feet of the
existing garage to livable space.
10. Landowner shall submit to the City a Use Restriction Covenant
preventing the new garage from being used for any purpose
other than parking of vehicles or storage of personal
property.
11. Run-off from all structures and hardscape on the site shall
be contained and directed to the street or other approved
drainage course subject to the review of the Director of
Public works.
12. All lot drainage deficiencies, if any, identified by the
Director of Public Works, shall be corrected prior to final
inspection.

13. Landowner shall submit to the City an irrevocable offer for
sewer and storm drain easements prior to issuance of building
permits.
14. Landowner shall submit to the City an irrevocable offer to
join a sewer district when one is formed prior to issuance of
building permits.
15. Landowner shall submit to the City a "Hold Harmless"
agreement prior to issuance of building permits.
16. All other necessary permits and approvals required pursuant
to the Rancho Palos Verdes Municipal Code or any other
applicable statute law or ordinance shall be obtained.
17. The Moratorium Exemption and Planning Approval shall become
void after 180 days unless an application for a building
permit is submitted and kept active through the Division of
Building and Safety.
