A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF RANCHO PALOS VERDES APPROVING THE
VARIANCE NO. 259 FOR A FENCE OVER 30 INCHES
IN HEIGHT TO BE LOCATED IN THE INTERSECTION
VISIBILITY TRIANGLE AT 29516 MIRALESTE PLAZA.
WHEREAS, the Los Angeles County Fire Department has requested
a Variance to allow a maximum 42 inch high wrought iron fence to
be located within the intersection visibility triangle at the
corner of Palos Verdes Drive West and Miraleste Drive.
WHEREAS, after notice pursuant to the City's Development
Code, a public hearing was held on May 22, 1990, at which time
all interested parties were given an opportunity to be heard and
present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:
Section 1: That there are exceptional or extraordinary
circumstances or conditions applicable to the property since the
lot is triangular in shape, and abuts public streets on all three
sides.
Section 2: That a Variance is necessary to preserve or allow
the enjoyment of a substantial property right of the applicant
which is possessed by other property owners under similar
conditions in the same zoning district, since the variance is
necessary to provide an adequate turning radius for emergency
vehicles exiting the site. Also, the variance would not grant a
special privilege to the applicant which privilege is not
currently enjoyed by other properties in the zoning district sine
the use is unique, being one of two fire stations in the City.
Section 3: That the granting of the Variance will not be
materially detrimental to the public welfare and injurious to
property and improvements in the area in which the property is
located, since the guardrail will provide safety for pedestrians
using the sidewalk and will not interfere with the traffic sight
lines at the intersection.
Section 4: That the Variance is not contrary to the
provisions of the General Plan since the fence will enhance the
function of the fire station which provides necessary emergency
services identified in the Safety Element of the General Plan.
Section 5: For the foregoing reasons and based on
information and findings included in the staff report, minutes,
and evidence presented at the public hearing, the Planning
Commission of the City of Rancho Palos Verdes hereby approves
Variance No. 259, subject to the conditions of approval attached
in Exhibit "A".

Exhibit "A"
1 . The approved fence in the intersection visibility
triangle shall be a maximum of 42 inches in height
measured from the top of the adjacent curb.
2 . The fence shall be constructed of wrought iron which will
allow 90% light and air to pass through.
3. The fence shall be of a color that matches or blends with
the building, subject to the approval of the Director of
Environmental Services.
