A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF RANCHO PALOS VERDES
APPROVING VARIANCE NO. 254 TO ALLOW A
SEVEN FOOT SIX INCH HIGH WROUGHT IRON
FENCE AND BLOCK WALL LOCATED AT 1 PARK PLACE.
WHEREAS , the Lorna Burrell has requested a Variance to allow
an existing 7 foot 6 inch wrought iron fence and wall to remain
along the front property line at 1 Park Place ; and
WHEREAS , after notice pursuant to the City ' s Development
Code , a public hearing was held on March 27 , 1990 , at which time
all interested parties were given an opportunity to be heard and
present evidence .
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS :
Section 1 : That there are exceptional or extraordinary
circumstances or conditions applicable to the property which do
not apply generally to other properties in the same zoning
district , in that the lot lacks a front property line adjacent to
the street of access . The property is adjoined to the street of
access by a parking lot and a utility and ingress easement . The
fence along the front property line is 600 feet from the closest
street of access and has no negative visual affect on the
surrounding area; and
Section 2 : That the Variance is necessary for the
preservation and enjoyment of a substantial property right of the
landowner. If it were not for the unusual location if this
property, which is surrounded by extreme slopes and is at the end
of a long easement and a parking lot for Del Cerro Park, the level
area of this lot , used presently for parking and as a sport court
would be set back out of the front setback. A physical barrier to
enclose the level portion of the yard used for out door recreation
would provide a property right to the applicant which is enjoyed
by other properties in the same RS-1 zone ; and
Section 3 : That granting of Variance will not be materially
detrimental to the public health, safety, and welfare since the
existing fence and wall can not be seen from the street and the
improvements made to the property do not adversely impact the
privacy or primary views of surrounding properties ; and
Section 4 : That the proposed development is in conformance
with the General Plan since the height of the fencing will provide
the property owners with additional privacy and the 90 percent
light and air wrought iron fence and 18 inch wall no not impair a
view or vista from a city-approved or identified public view or
vista.

Section 5: A City Landscape Covenant to protect views shall
be submitted to the Director of Environmental Services within 30
days of this approval.
Section 6: For the foregoing reasons, the Planning
Commission of the City of Rancho Palos Verdes hereby approves
Variance No. 254 subject to the conditions of approval in Exhibit
"A".

1. The landowner shall submit a notarized Landscape Covenant to
protect views for recordation within 30 days of approval .
