PC RES 1990-017 411 411 P.C . RESOLUTION NO. 90 - 17 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING VARIANCE NO. 252 AT 2175 ROCKING HORSE. WHEREAS , Mr. Stefano Finazzo has requested a Variance to allow for the reduction of a side yard slope setback for an existing room addition at 2175 Rocking Horse ; and WHEREAS , after notice issued pursuant to the provisions of the Rancho Palos Verdes Development Code , a public hearing was held on March 27 , 1990 at which time all interested parties were given an opportunity to be heard and present evidence ; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS : Section 1 : That there are exceptional or extraordinary circumstances or conditions applicable to the property which do not apply generally to other properties in the same zoning district , in that the lot size is substandard and does not meet the requirements of the RS-2 zoning district and the lot contains a transitional slope which greater than two to one . Section 2 : That the Variance is necessary for the preservation and enjoyment of a substantial property right of the landowner, since the property owner is further restricted to develope his property due to the size and nature of the lot and because the addition does not significantly increase the total lot coverage on the property. Section 3 : That the granting of the Variance will not be materially detrimental to the public health, safety, and welfare because the addition does not adversely affect the privacy or views of adjacent properties and the does not alter the characteristics of the neighborhood. Section 4 : That the granting of the Variance will not be contrary to the objectives of the General Plan since the property is consistent with the development guidelines required in an RS-2 zoning district even though the lot is substandard. Section 5 : Notwithstanding the limited impact of the roof addition, the satellite dish antenna existing atop the structure falls within the required slope setback. Permitting the antenna to remain in its present location in conjunction with granting the variance would confer a special privilege to the applicant in excess of what other similarly situated owners possess , and causes a material detriment and injury to adjacent property owners since in its present roof-mounted position, the antenna obstructs the views of adjacent property owners . !II 410 Section 6 : For the foregoing reasons , and based on the information and findings provided in the Staff Report , the Planning Commission of the City of Rancho Palos Verdes hereby approves Variance No . 252 subject to the conditions outlined in the attached Exhibit "A" . Resolution No . 90 - 17 Page 2 111 110 Exhibit A Variance #252 Conditions of Approval 1 ) That the landowner remove the unapproved satellite dish antenna from its existing location atop the room addition and relocate the satellite dish antenna to the ground mounted location "A" as previously approved by Site Plan Review No . 4922 , and upheld by City Council Resolution 89-92 . 2) That the landowner submit a Covenant to Protect Views (Landscape Covenant) that runs with the land in order to protect views that may be impaired by any vegetation on the owner 's property. 3 ) That the landowner obtain all required Building Permits and pay any necessary penalty fees . 4) That the landowner provide the Building and Safety Department a soils report prepared by a certified engineer.
