PC RES 1990-015P.C. RESOLUTION NO. 90-15 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING AMENDMENT "A" TO CONDITIONAL USE PERMIT NO. 99. WHEREAS, "R & R" Market and the owners of La Mancha Shopping Center have requested an amendment to the original Conditional Use Permit No. 99 for the commercial center to allow on-site liquor sales with off-site consumption for the middle eastern (Persian) market located in suite 101 at 29505 Western Avenue; and WHEREAS, after notice pursuant to the Development Code, public hearings were held on Tuesday, March 13, 1990, at which time all interested parties were given the opportunity to give testimony and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: The Planning Commission has reviewed and considered the findings of the Staff Report prior to making a decision on the project. Based on this review the Planning Commission finds that there will be no significant or adverse effects on adjacent property or the permitted use resulting from this project due to implementation of the conditions of approval contained in Exhibit "A", attached hereto and made a part hereof. Section 2: That the granting of the amendment of Conditional Use Permit No. 99 will not be contrary to the objectives of the Specific Plan III or of the General Plan in that the proposed use complies with Specific Plan III, the General Plan and zoning land use designations. Section 3: That the subject site is adequate in size and shape to accommodate the intended use. The site conforms with the minimum lot size and the location of the market within the commercial center was approved through the original Conditional Use Permit. The environmental impacts associated with this type of commercial project which might be caused by adjacent incompatible uses were discussed with the original Conditional Use Permit. Section 4: That the site is serviced by Western Avenue and Crestwood whose capacity is adequate to serve the site and proposed use without suffering significant impacts to their level of service. f 4 Section 5: For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes does hereby approve the amendment to Conditional Use Permit No. 99 subject to the conditions contained in Exhibit "A", attached hereto and made a part hereof, which are necessary to preserve the public health, safety and general welfare in the area. Resolution No. 90-15 Page 2 EXHIBIT "A" CONDITIONS OF APPROVAL 1. The sale of alcoholic beverages shall be permitted only between the hours of 8:00 a.m. and 9:00 p.m. each day of the week. 2. No coin-operated amusement devices shall be maintained on the licensed premises. 3. The petitioners shall be responsible for maintaining free of litter the area adjacent to the premises over which he has control. 4. The petitioner shall be responsible for maintaining free of loiterers the area adjacent to the premises over which he has control. 5. No alcoholic beverages shall be consumed on any property adjacent to the licensed premises under the control of the licensees. 6. There shall be no exterior advertising of any kind or type, including advertising directed to the exterior from within, promoting or indicating the availability of alcoholic beverages. 7. This approval shall not permit the establishment of a convenience store as defined in Development Code Section 16.04.315 and as regulated in chapter 17.25. 8. A major changeover in marketing goods within "R & R" and/or a change in corporate ownership shall require an additional amendment to the Conditional Use Permit. 9. A staff site review, prior to annual issuance of business licence, shall be required to assure that the middle eastern (Persian) market is not converted to what could be considered primarily a liquor store, a mini -mart or convenience store, In the event there is evidence that the conditions of approval have not been complied with, the item shall be brought up with the Planning Commission for review.
