P.C. RESOLUTION NO. 90-12
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF RANCHO PALOS VERDES ADOPTING A NEGATIVE
DECLARATION AND APPROVING REVISION "A" TO
CONDITIONAL USE PERMIT NO. 31 AND ENCROACHMENT
PERMIT NO. 17 TO INSTALL GUARDHOUSES AT EACH
ENTRANCE TO TRACT NO. 33206.
WHEREAS, the Rancho Palos Verdes Estates Homeowner's
Association requested approval for the installation of security
devices at the entrances to project and that the Planning
Commission recommend vacation of the public streets in Tract
No. 33206 to the City Council; and
WHEREAS, after notice issued pursuant to the provision of the
Rancho Palos Verdes Development Code, a public hearing was held on
February 27, 1990 at which time all interested parties were given
and opportunity to be heard and present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:
Section 1: That the proposal will have no significant
impacts on the environment, due to the implementation of the
mitigation measures contained in the Final Negative Declaration
for Environmental Assessment No. 599, which have been incorporated
into the conditions of approval and the design of the project.
Section 2: That the proposed project is not contrary with
the intent of the General Pian, since access to the public trails
and vista points will be maintained and enhanced.
Section 3: That, given the project's location, design and
the uses adjacent to the subject property, which include single
family residential and institutional uses granting the Conditional
Use Permit will not adversely affect the peace, health, safety or
general welfare of the area, nor will it be materially detrimental
to property values, jeopardize, endanger or otherwise constitute a
menace to the public health, safety, or general welfare of persons
or properties in the surrounding since the guardhouses will
provide added security for the development, especially at night,
the streets will remain on public ownership, no gates or barriers
will be installed across the roads and the applicant will be
required to comply with standard encroachment conditions of
approval, per City Council policy.
Section 4: That the subject property being approximately
60 acres, is adequate in size and shape to accommodate the
proposed uses and other development features which with be
prescribed in the Resolution, in that the main entrance on Avenida
de Pino is already designed to accommodate a guardhouse and the
secondary entrance on Avenida de Rosa can be modified to
accommodate a guardhouse structure.
Section 5: That the subject property, which fronts Crest
Road, a fully developed street with curbs and gutters and is
adequately served by public and private facilities and by a
highway of sufficient width and improvements to carry the kinds
and quantity of traffic the proposed project might generate.
section 6: For the foregoing reasons, and based on
information and findings provided in the staff report, minutes and
evidence presented at the public hearing the Planing Commission of
the City of Rancho Palos Verdes hereby grants the Negative
Declaration for Environmental Assessment No. 599 and amends
Conditional Use Permit No. 31 and grants Encroachment Permit No.
17 to allow guardhouses to be .installed at each vehicular entrance
to the tract, subject to the conditions of approval in Exhibit "A"
of this resolution.

EXHIBIT "A"
Conditions of Approval
Conditional Use Permit No. 31 Revision "A"
1. The applicant shall provide a hold -harmless agreement.
2. The applicant shall agree to remove the encroachment at the
direction of the Public Works Director on 10 days notice
except in emergency situation where removal may be required
on shorter notice. If the owner fails to remove the
encroachment within the specified time, the City will do the
work and the owner will be billed.
3. The applicant shall obtain liability insurance ($500,000 -
$1,000,000), naming the City as additional insured, and
provide a copy of said insurance policy annually.
4. The applicant shall record the above conditions as conditions
running with the land to the satisfaction of the City
Attorney. The owner must obtain formal Encroachment Permit
from the Public Works Department.
5. The final design and placement of the two guardhouses shall
be subject to the review and approval of the Director of
Environmental Services.
6. All roads within Tract No. 33206 shall remain public.
7. No gates or other barriers shall be installed across the
roadway. Security officers, employed and insured by the
Rancho Palos Verdes Estates Homeowners Association shall
monitor transient vehicular traffic into the development.
8. The applicant shall dedicate to the City of Rancho Palos
Verdes a multipurpose trail across the western portion of
common open space Lot No. 83 consistent with the Trails
Network Plan. Final design and placement of the trail
easement shall be subject to the review and approval of the
Trails Committee.
