PC RES 1989-072P.C. RESOLUTION 89-72 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING VARIANCE NO. 246 AND GRADING PERMIT APPLICATION NO. 1342 FOR THE REPLACEMENT OF A SIDEYARD RETAINING WALL AT 2070 NOBLEVIEW DRIVE. WHEREAS, on November 1, 1989, Dorothy R. Romeo submitted a variance and grading application to request approval to replace an existing retaining wall located along the east side property line of 2070 Nobleview Drive; and WHEREAS, on December 12, 1989, the Planning Commission held a public hearing to consider this request at which time all interested parties were invited to attend and give testimony. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY RESOLVE: Section 1: That the proposed grading and retaining wall minimize disturbance to the existing condition of the site and are necessary to preserve the stability of the applicant's slope. The proposed grading and wall replacement also would not raise or lower the existing grade elevation of either adjoining property; therefore, no adverse visual impact is anticipated. Section 2: That the east sideyard has an existing vertical cut which is retained by the unpermitted retaining wall. The adjacent downslope residence and driveway are within six (6) feet of the wall. Requiring the slope to be restored under these circumstances would be infeasible (see attached memo from the City Geotechnical consultant). Section 3: That the replacement wail is necessary to preserve the stability of the applicant's property and to allow the adjacent downslope neighbor to maintain adequate driveway area and an adequate setback from the slope. Section 4: That the replacement wall will not be detrimental or injurious to public welfare or property and improvements on the area provided the portion of the wall that encroaches into the public right-of-way is removed. The replacement wall would be essentially perpendicular to the front property line thereby forestalling concern that the structure will have an overly massive appearance from the street. Section 5: That the proposed project would not change the present residential use of the site and would encourage and assist in the maintenance and improvement of the residential neighborhood (as called for in Policy #3 p. 78 of the General Plan). Section 6: For the foregoing reasons, the Planning Commission hereby approves Variance No. 246 and Grading Permit Application No. 1342 subject to the conditions included in attached Exhibit "A", said conditions being necessary for the protection of the public health, safety, and general welfare. 1989. Resolution 89-72 Page 2 411 111 EXHIBIT "A" Conditions of approval for Variance No . 246 and Grading Permit Application No . 1342 : 1 . Both applicants shall submit City Landscape Covenants to the Director of Environmental Services prior to issuance of a building permit . 2 . No portion of the replacement wall shall be allowed within the public right-of-way. The portion of the existing wall within the public right-of-way shall be removed within 120 days . 3 . Replacement of the wall shall be limited to approximately the same location, height (not to exceed six [ 6] feet of retention) , and size as the existing wall except that no portion of the wall shall be allowed within the public right- of-way . 4. A building permit for the replacement wall shall be obtained prior to construction. 5 . All recommendations of the City Geotechnical consultant shall be incorporated into the project . 6 . The applicant shall acknowledge , in writing with 30 days of this approval , that all conditions of approval have been read, understood, and accepted. F.C . Resolution 89-72 Page 3
