A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF RANCHO PALOS VERDES GRANTING A CONDITIONAL USE
PERMIT No. 23 REVISION "HH" AND GRADING PERMIT NO .
1252 MODIFYING A REQUEST TO ALLOW GRADING, A REAR
YARD RETAINING/FREESTANDING WALL, STAIRS , WALKWAYS
FOR RETAINING WALLS AND A FOUNTAIN WHICH DECREASE
THE REQUIRED MINIMUM OPEN SPACE AT AN EXISTING
SINGLE FAMILY RESIDENCE AT 32525 SEACLIFF DRIVE.
WHEREAS , James Tam has requested a Conditional Use Permit
Revision and Grading Permit to allow 370 cubic yards of grading,
an 8 foot solid wall which retains 5 feet of earth, four retaining
walls over 42" , stairs , walkways and a fountain and a decrease of
the required minimum open space from 65% to 38%.
WHEREAS , after notice issued pursuant to the provisions of
the City ' s Development Code, a hearing was held on August 8 , 1989 ,
at which time all interested parties were given an opportunity to
be heard and to present evidence .
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS :
Section 1 : That the proposed revision and additions , as
modified, are consistent with the original Conditional Use Permit .
Section 2 : That the private outdoor living area is in excess
of the requirements for a Residential Planned Development .
Section 3 : That the proposed project , as modified, is not
contrary to the General Plan or Development Code since conformance
has been insured by design modifications and landscaping
requirements , which are included as conditions of approval to this
permit .
Section 4 : That given the project ' s site design and
conditions imposed through this permit , the granting of this
Conditional Use Permit Revision will not significantly adversely
affect the peace , health, safety or general welfare of the area,
nor will it be materially detrimental to property values ,
jeopardize , endanger or otherwise constitute a menace to the
public health, safety, and welfare of persons in the surrounding
area.
Section 5: For the foregoing reasons, the Planning
Commission of the City of Rancho Palos Verdes hereby grants a
Conditional Use Permit No. 23 -Revision "HH", and Grading Permit
No. 1252 for the use described herein, subject to the conditions
contained in Exhibit "A", which are necessary to protect the
public health, safety and general welfare in the area.

EXHIBIT "A"
CONDITIONAL USE PERMIT NO. 23 - REVISION
AND GRADING PERMIT NO. 1252

1. The graded area of the back yard shall be restored to the
original contours of the lot as shown on the approved plans
of Conditional Use Permit No. 23 -Revision "C".
2. The height of the solid wall adjacent to the rear property
line shall be reduced so that it retains no more than 3 feet
6 inches and does not exceed 6 feet in total height with the
portion over 42 inches consisting of a fence of 90% light and
air.
3. The height of the four unapproved retaining walls in the rear
yard of the property shall be reduced to 3 feet 6 inches in
height, as measured from grade.
4. A landscape, irrigation, and fencing plan for the entire
property shall be submitted to the Director of Environmental
Services for review and approval. Landscaping shall be
consistent with the Seacliff Guidelines.
5. A landscape covenant shall be recorded and run with the land.
Landscaping on the property shall be maintained so it does
not cause significant view obstruction for surrounding
properties.
