PC RES 1989-040 111 P .C . RESOLUTION NO . 89- 40 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING VARIANCE NO . 235 AND COASTAL PERMIT NO . 71 TO ALLOW A REDUCTION IN THE SETBACK REQUIREMENTS FOR A 245 SQUARE FOOT ADDITION AND DENY A 94 SQUARE FOOT DECK OVER AN EXTREME SLOPE, LOCATED WITHIN THE COASTAL DISTRICT AT 203 SEASCAPE . WHEREAS , Mr. William Hassoldt has requested a Variance and Coastal Permit for a reduction in the side yard setback requirements and additions to exceed the 250 square foot maximum within the Coastal Specific Zone , at 203 Seascape ; and WHEREAS , after notice issued pursuant to the provisions of the Rancho Palos Verdes Development Code , a public hearing was held on July 25 , 1989 , at which time all interested parties were given an opportunity to be heard and present evidence ; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS : Section 1 : That there are exceptional or extraordinary circumstances or conditions applicable to the property which do not apply generally to other properties in the same zoning district , in that the lot size and dimensions are substandard and do not meet the requirements of the RS-2 zoning district . Section 2 : That the Variance is necessary for the preservation and enjoyment of a substantial property right of the landowner, since the original configuration and orientation of the residence in relationship to the property lines and use areas would not allow reasonable additions to be made without conflicting with setback requirements . Section 3 : That granting of Variance will not be materially detrimental to the public health, safety , and welfare since the improvements made to the property do not adversely impact the privacy or primary views of surrounding properties . Section 4 : The proposed development is in conformance with the Coastal Specific Plan since the subject property is not located in an Open Space Hazard Zone , there is no additional water usage and the 245 square foot expansion is considered a minor addition. Section 5 : That the existing development , which is located between the sea and the first public road , is in conformance with applicable public access and recreation policies of the Coastal Act , in that there are no public trails or access point on the subject property which the proposed addition disturbs . Section 6 : The denial of the 94 square foot deck will not deny the property owner enjoyment of outdoor living area as he is in possession of a 1319 square feet of level yard area adjacent to his home . Section 7 : For the foregoing reasons , the Planning Commission of the City of Rancho Palos Verdes hereby approves Variance No . 235 and Coastal Permit No . 71 subject to the conditions of approval in Exhibit "A" . Resolution No . 89-40 Page 2 III 110 EXHIBIT "A" Variance No . 235/Coastal Permit No . 71 203 Seascape 1 . A City Landscape Covenant to maintain property to protect views shall be submitted to be recorded prior to issuance of Building Permits . 2 . The landowner shall submit a notarized Liability Waiver as the proposed improvements are located in the Landslide Moratorium. 3 . The landowner shall submit a geology/soils report to the City Geologist for review and approval . 4 . No additional square footage beyond the approved 245 square foot expansion to the bedroom and living room shall be added to the residence . 5 . No additional lot coverage shall be approved in the future . 6 . The 1274 square feet of existing patio area shall remain open and uncovered. 7 . The one foot three inch sideyard encroachment along the westerly sideyard shall match the existing building line and shall be no greater than 5 ' habitable space . P . C . Resolution No . 89-40 Page 3
