PC RES 1989-033 111 P.C . RESOLUTION NO . 89-33 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING VARIANCE NO . 233 TO ALLOW A SIX FOOT HIGH BLOCK WALL AND WROUGHT IRON GATE AND REDUCTION IN THE FRONT SETBACK REQUIREMENT LOCATED AT 27922 LONGHILL DRIVE. WHEREAS , Edward and Janet Hallett have requested a Variance for a reduction in the front yard setback requirement to allow a six foot high wall and wrought iron gate to be constructed 10 feet from the front property line at 27922 Longhill Drive ; and WHEREAS , after notice issued pursuant to the provisions of the Rancho Palos Verdes Development Code , a public hearing was held on June 13 , 1989, at which time all interested parties were given an opportunity to be heard and present evidence ; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS : Section 1 : That there are exceptional or extraordinary circumstances or conditions applicable to the property which do not apply generally to other properties in the same zoning district , in that the lot is adjoined to the street of access by a 105 foot long flag . The lot is constrained by sharing the same ingress egress easement with lots 25 , 26 and 28 and lacks a front property line adjacent to the street of access ; and Section 2 : That the Variance is necessary for the preservation and enjoyment of a substantial property right of the landowner, since the configuration and orientation of the residence in relationship to the property lines and use areas does not allow reasonable privacy or adequate space on the property to insure privacy and setback from the driveway without conflict with setback requirements ; and Section 3 : That granting of Variance will not be materially detrimental to the public health, safety, and welfare since the improvements made to the property do not adversely impact the privacy or primary views of surrounding properties ; and Section 4 : The proposed development is in conformance with the General Plan since the height of the fencing will provide the property owners with additional privacy and reduce noise from traffic on the flag easements shared by the adjacent properties . Section 5 : For the foregoing reasons , the Planning Commission of the City of Rancho Palos Verdes hereby approves Variance No . 233 subject to the conditions of approval in Exhibit 111 PASSED, APPROVED, and ADOPTED this 13th day of June 1989 .
