A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF RANCHO PALOS VERDES APPROVING A REVISION
TO VARIANCE NO. 217 FOR A FOUR (4) FOOT ENCROACHMENT
INTO THE REAR YARD SETBACK TO ACCOMMODATE A
SECOND`STORY ADDITION AND APPROVING THE APPEAL
TO HEIGHT VARIATION NO. 568 RESTRICTING THE
PLACEMENT OF WINDOWS ON THE EAST ELEVATION AT 6343 VILLA
ROSA DRIVE.
WHEREAS, A.A. Osborne and E.G. Osborne have requested a
revision to Variance No. 217 to allow for a four (4) foot
encroachment into the rear yard setback to accommodate a second
story addition; and
WHEREAS, the Director of Environmental Services approved
Height Variation No. 568 for a second story addition located at
6343 Villa Rosa Drive; and
WHEREAS, on May 1, 1989, Mr. and Mrs. Richard Y. Kurohara
filed an appeal of the Height Variation to the Planning
Commission within 15 days of the decision of the Director of
Environmental Services; and
WHEREAS, after notice issued pursuant to the provisions of
the Rancho Palos Verdes Development Code, a public hearing was
held on May 9, 1989 at which time all interested parties were
given an opportunity to be heard and present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: That there are exceptional or extraordinary
circumstances or conditions applicable to the property involved or
to the intended use of the property which do not apply generally
to other property in the same zoning district, since the property
is irregular in shape compared to other properties in the
vicinity;
Section 2: That such Variance is necessary for the
preservation and enjoyment of a substantial property right of the
applicant, which right is possessed by other property owners under
like conditions in the same zoning district since the orientation
of the house on the property limits the ability to comply with
Code requirements;
Section 3: That the granting of such a Variance will not be
materially detrimental to the public welfare or injurious to
property and improvements in the area in which the property is
located since the second story addition to the residence will not
impair the primary viewing area of properties within the vicinity;

Section 4: That the granting of such a Variance will not be
contrary to the objectives of the General Plan since the intent of
the General Plan is to encourage high quality residential
development, the proposal will be enhancing the property;
Section 5: That the project is categorically exempt (Class
III) from the requirements of the California Environmental Quality
Act.
Section 6: The proposed structure as revised is designed and
situated in such a manner as to minimize view obstruction.
Section 7: That the development over 16 feet in height does
not significantly impair any primary view for the properties
within the vicinity.
Section 8: That the proposed structure is not located on a
ridge or promontory.
Section 9: That the structure does not significantly impair
a view or vista from public property (parks, major thoroughfare,
bikeways, walkways, equestrian trail, etc.) which has been
identified in the City's General Plan, Coastal Plan, or City -
approved viewing areas.
Section 10: That there is no significant cumulative impact
caused by granting the application.
Section 11: For the foregoing reason, the Planning
Commission of the City of Rancho Palos Verdes hereby approves the
revision to Variance No. 217 and approves the appeal of Height
Variation No. 568 thereby conditioning the placement of the
windows on the east elevation as noted in Exhibit "A".
PASSED, APPROVED, and ADOPTED on May 9, 1989.

REVISION TO VARIANCE NO. 217
HEIGHT VARIATION 568 - APPEAL
6343 VILLA ROSA DRIVE
•
1. The windows on the east elevation shall be restricted to
placement of a minimum six (6) feet above the floor level.
2. A landscape covenant shall be submitted to the Department of
Environmental Services.
3. A second unit covenant shall be submitted to the Director of
Environmental Services.
4. The windows on the east elevation and the bedroom window on
the north elevation shall be reduced in size to the minimum
allowed by the Building Code.
5. The proposed second story addition shall not be closer than
1216" to the front property line, not closer than 6'8" from
the side property line parallel to the driveway, and the
minimum rear setback of 15' shall be maintained unless an MEP
or Variance is granted to reduce this requirement.
6. A 4 foot high grapestake fence shall be allowed no closer
than 3 feet from the retaining wall along Villa Rosa .
7. A landscape plan shall be submitted to the Director of
Environmental Services for the yard area between the sidewalk
and fence.
8. The retaining wall shall not exceed 3 feet 6 inches in height
parallel to the driveway.
9. The retaining wall beyond the proposed addition may increase
to a maximum of 5 feet in height.
10. The retaining wall shall be placed a minimum of 3 feet from
the interior and rear property lines.
11. The proposed second story addition shall not be closer than
12 feet 6 inches to the from property line.
12. Approval of the reduced front setback for the second story
addition is subject to approval of Height Variation No. 568.
13. The chainlink fence shall be removed within one year of this
approval.

14. The applicant shall submit a letter accepting and agreeing to
all of the conditions of approval of this Variance within
thirty (30) days, otherwise this Variance shall be null and
void.
