A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF RANCHO PALOS VERDES APPROVING
VARIANCE NO. 231 FOR A 15 FOOT REDUCTION
IN THE FRONT YARD SETBACK FOR THE CONVERSION
OF THE EXISTING CARPORT INTO A GARAGE AND COASTAL
PERMIT NO. 66, AND DENYING THE REQUEST FOR A
15 FOOT REDUCTION IN THE FRONT YARD SETBACK
FOR A SECOND STORY ADDITION, AT 4104 PALOS
VERDES DRIVE SOUTH.
WHEREAS, Mr. Charles Good has requested a Variance and
Coastal Permit to allow a 15 foot reduction in the front yard
setback to accommodate a second story addition over a portion
of an existing single story residence and to allow a 15 foot
reduction in the front yard setback to convert the existing
carport into a garage;
WHEREAS, after notice pursuant to the City's Development
Code, a public hearing was held on April 11, 1989, at which
time all interested parties were given an opportunity to be
heard and present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE
AS FOLLOWS:
Section 1: That there are exceptional or extraordinary
circumstances or conditions applicable to the size, shape,
topography, development or location of the subject property,
since the carport was originally built five (5) feet from the
front property line;
Section 2: That a Variance for the garage conversion is
necessary to preserve or allow the enjoyment of a substantial
property right of the applicant which is possessed by other
property owners under similar conditions in the same zoning
district, since the adjacent properties currently have
garages;
Section 3: That the granting of the Variance for the
conversion of the carport into a garage will not be
materially detrimental to the public welfare, since other
properties in the immediate neighborhood have similarly
located garages;
However, that the granting of the Variance for the second
story addition will be materially detrimental to the public
welfare, since a second story addition located 5 feet from
the front property line would be obtrusive from the sidewalk
and would infringe on views from properties within the
vicinity;

Section 4: That the granting of the Variance will not be
contrary to the objectives of the General Plan, since the
intent of the General Plan is to encourage high quality
residential development, the proposed garage will enhance the
property as well as adjacent properties and further the
policies of the City to have enclosed parking spaces for all
residential properties;
Section 5: For the foregoing reasons, the Planning
Commission of the City of Rancho Palos Verdes hereby approves
Variance No. 231 and Coastal Permit No. 66 subject to the
conditions in Exhibit "A".

EXHIBIT "A"
1 . A City landscape covenant shall be recorded. The two
trees within the front setback area, closest to the east
property line , shall be removed to enhance the views from
the frontage road of Palos Verdes Drive South between
Admirable Drive and Palos Verdes Drive South.
2 . The garage shall not be closer than 5 feet from the front
property line .
3 . All code violations on the property shall be corrected
within 30 days of this approval .
