A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF RANCHO PALOS VERDES APPROVING
VARIANCE NO. 226 FOR A TRASH ENCLOSURE AND
DENYING TWO 6 '8" LIGHT FIXTURES AT 60 LAUREL
DRIVE.
WHEREAS , Berry Point Partnership has requested a Variance to
allow an existing trash enclosure and light fixtures exceeded the
maximum allowed heights and located within the front 20 foot
setback at 60 Laurel Drive .
WHEREAS , after notice pursuant to the City ' s Development
Code , a hearing was held on March 28 , 1989, at which time all
interested parties were given an opportunity to be heard and
present evidence .
HOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS :
Section 1 : That there are exceptional or extraordinary
circumstances or condition applicable to the property since the
front of the lot is adjacent to a private driveway and is a common
recreational lot as part of a Residential Planned Development .
Section 2 : That a Variance is necessary to preserve or allow
the enjoyment of a substantial property right of the applicant
which is possessed by other property owners under similar
conditions in the same zoning district , since the trash on the
property must be disposed of properly. Due the necessity for a
commercial size dumpster in a Residential Zone , it is difficult to
locate the dumpster and enclosure is a convenient location that
is outside of the setbacks.
Section 3 : That the granting of the Variance will not be
materially detrimental to the public welfare or injurious to
property and improvements in the area in which the property is
located, since the structure blends with the architecture of the
clubhouse and is screened by landscaping.
Section 4 : That the granting of the Variance will not be
contrary to the objectives of the General Plan, as there are no
negative impacts since the structure is substantially screened
from view from adjacent public and private properties.
Section 5 : That as a condition of approval the landscaping
adjacent to the trash enclosure shall be maintained to screen the
structure .
Section 6 : That as a condition of approval the light
fixtures shall be lowered to a maximum height of 42 inches or
relocated outside of the front 20 foot setback within 60 days .

Section 7 : For the foregoing reasons , the Planning
Commission of the City of Rancho Palos Verdes hereby approves
Variance No. 226.
