RESOLUTION P.C. NO. 89 - 12
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF RANCHO PALOS VERDES DENYING
VARIANCE NO. 223 AT 1908 LASITA PLACE
WHEREAS, Mr, and Mrs. Bob Lucin have requested a
Variance to allow the conversion of an existing indirect
access garage to a direct access garage with a minimum
setback of 14 feet from the front property line.
WHEREAS, after notice pursuant to the City's Development
Code, a public hearing was held on March 14, 1989, at which
time all interested parties were given an opportunity to be
heard and present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE
AS FOLLOWS:
Section 1: That there are no exceptional or
extraordinary circumstances or conditions applicable to the
size, shape, topography, development or location of the
subject property.
Section 2: That a Variance is not necessary to preserve
or allow the enjoyment of a substantial property right of the
applicant which is possessed by other property owners under
similar conditions in the same zoning district, since the
applicant already has a two -car garage and existing setbacks
which are similar to other residences in the tract.
Section 3: That the granting of the Variance will be
materially detrimental to the public welfare or injurious to
surrounding properties, since the new curb cut would result
in the loss of one on -street parking space and two off-street
parking spaces, and would create a safety hazard if cars
parked in the driveway and encroached onto the sidewalk.
Section 4: That the granting of the Variance will be
contrary to the objectives of the General Plan, since it will
not enhance the physical quality of the neighborhood and
could create a safety hazard.
Section 5: For the foregoing reasons, the Planning
Commission of the City of Rancho Palos Verdes hereby denies
Variance No. 223.
