A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF RANCHO PALOS VERDES APPROVING VARIANCE
NO. 222 FOR EXISTING FENCING EXCEEDING THE SIX
(6 ) FOOT (FROM HIGH SIDE OF GRADE) AND EIGHT (8)
FOOT (FROM LOW SIDE OF GRADE) AT 27600 , 27604 ,
27612 , 27624 , 27630 , 27654 TARRASA DR.
WHEREAS , Linda Hill and Aileen Christianson, John and
Trinidad Cooper, Raymond and Jane Donelson, Erma L . Smith, Molly
Lebsack, and Theresa Skubik have requested a Variance for existing
fencing along the rear property line exceeding six ( 6 ) feet in
height ; and
WHEREAS , after notice pursuant to the provision of the Rancho
Palos Verdes Development Code , a public hearing was held February
28 , 1989 at which time all interested parties were given an
opportunity to be heard and present evidence .
WHEREAS , THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS
FOLLOWS :
Section 1 : That there are exceptional or extraordinary
circumstances and conditions applicable to the property involved
which do not apply generally to other properties in the same
zoning district , in that the lots are constrained by unusual
topography and the rear property lined are parallel to a state
highway.
Section 2 : That there are special circumstances which
unreasonably restrict the applicant ' s ability to develop the
property in conformance with City development regulations , in that
Western Avenue is at a higher elevation than the subject
properties minimizing privacy .
Section 3 : That the granting of the Variance will not be
materially detrimental to the public welfare or injurious to
property and improvements in the area in which the property is
located, since the fencing does not impair the views or privacy
enjoyed by surrounding properties .
Section 4 : That the granting of the Variance will not be
contrary to the objectives of the General Plan, since the height
of the fencing will provide the property owners with additional
privacy, and reduce glare and noise generated by traffic on the
adjacent state highway.

Section 5 : For the foregoing reasons , the Planning
Commission of the City of Rancho Palos Verdes hereby approves
Variance No . 222 , subject to conditions in Exhibit "A" , for
fencing exceeding six (6) feet in height located at 27600 , 27604 ,
27612 , 27624 , 27630 , 27654 , Tarrasa Drive .
PASSED, APPROVED and ADOPTED this 28th day of February , 1989 .

EXHIBIT "A"
1 . A landscape covenant shall be submitted for each property to
the Department of Environmental Services prior to issuance of
a building permit .
2 . This approval shall expire within 180 days unless extended by
the Planning Commission.
3 . The fencing shall be painted a uniform color acceptable to the
Director of Environmental Services .
4 . The fencing shall not exceed the existing height on Western
Avenue and shall not be higher than 3 feet above the brick
wall at 27600 , 27604 , 27612 and 27624 ; and 5 feet above the
brick wall at 27654 Tarrasa,
5 . A revised fencing plan consistent with those conditions of
approval shall be submitted to the Department of Environmental
Services for review and approval within 30 days . All fencing
shall be modified to conform to this revised plan within 60
days of the Department of Environmental Services approval of
the revised plan .
