A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF RANCHO PALOS VERDES APPROVING VARIANCE
NO. 217 AND GRADING NO. 1192 FOR AN ENCROACH-
MENT INTO THE FRONT YARD SETBACK FOR AN EXISTING
NON -CONFORMING FENCE, GRADING IN THE FRONT YARD,
A RETAINING WALL IN AN EXTREME SLOPE, AND DENYING
A STRUCTURE IN THE EXTREME SLOPE LOCATED AT 6343
VILLA ROSA.
WHEREAS, A.A. Osborne and E.G. Osborne have requested a
Variance to allow an addition to an existing house encroaching 7
feet 6 inches into the front yard setback, a 6 foot high solid
fence and existing non -conforming fencing in the front yard
setback, grading in the front yard on an extreme slope and a
retaining wall and garage addition in the extreme slope.
WHEREAS, after notice issued pursuant to the provisions of
the Rancho Palos Verdes Development Code, a public hearing was
held on November 22 and December 13, 1988 at which time all
interested parties were given an opportunity to be heard and
present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: That there are exceptional or extraordinary
circumstances or conditions applicable to the property involved,
or to the intended use of the property whish do not apply
generally to other property in the same zoning district, since the
property is irregular in shape compared to other properties in the
vicinity;
Section 2: That such Variance is necessary for the
preservation and enjoyment of a substantial property right of the
applicant, which right is possessed by other property owners under
like conditions in the same zoning district since the orientation
of the house on the property limits useable yard space to the yard
adjacent to Villa Rosa Drive;
Section 3: That the granting of such a Variance will not be
materially detrimental to the public welfare or injurious to
property and improvements in the area in which the property is
located since the fence will not interfere with traffic visibility
or views and the second story addition will conform to the
existing ground floor setback;
Section 4: That the granting of such a Variance will not be
contrary to the objectives of the General Plan since the intent of
the General Plan is to encourage high quality residential
development, the proposals will enhance the property as well as
adjacent properties;
Section 5: That this project is categorically exempt (Class
III) from therequirementsof the California Environmental Quality
Act; and
Section 6: For the foregoing reasons, the Planning
Commission of the City of Rancho Palos Verdes hereby approves
Variance No. 217 and Grading No. 1192 subject to the conditions of
approval in Exhibit "A", such conditions being necessary to
preserve and protect the public health, safety and welfare.

EXHIBIT "A"
CONDITIONS OF APPROVAL
FOR VARIANCE NO. 217 AND GRADING NO. 1192
1. A 4 foot high grapestake fence shall be allowed no closer
than 3 feet from the retaining wall along Villa Rosa.
2. A landscape plan shall be submitted to the Director of
Environmental Services for the yard area between the sidewalk
and fence.
3. The retaining wall shall not exceed 3 feet 6 inches in height
parallel to the driveway.
4. The retaining wall beyond the proposed addition may increase
to a maximum of 5 feet in height.
5. The retaining wall shall be placed a minimum of 3 feet from
the interior and rear property lines.
6. The proposed second story addition shall not be closer than
12 feet 6 inches to the front property line.
7. Approval of the reduced front setback for the second story
addition is subject to approval of Height Variation No. 568.
8. The chainlink fence shall be removed within one year of this
approval.
9. The applicant shall submit a letter accepting and agreeing to
all of the conditions of approval of this Variance within
thirty (30) days, otherwise this Variance shall be null and
void.
