A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF RANCHO PALOS VERDES APPROVING
EXTREME SLOPE PERMIT NO. 8 FOR A 400 SQUARE
FOOT DECK EXTENDING SIX FEET OVER AN EXTREME
SLOPE AT 5555 GRAYLOG.
WHEREAS, Carolynn Dirks and Phillip Dougherty have
requested an extreme slope permit for a 400 square foot rear
yard deck extending not more than six (6) feet over an
extreme slope; and
WHEREAS, after notice issued pursuant to the provisions
of the Rancho Palos Verdes Development Code, a public hearing
was held on October 25, 1988 at which time all interested
parties were given an opportunity to be heard and present
evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE
AS FOLLOWS:
Section 1: That the site cannot reasonably accommodate
the structure in another location not involving an extreme
slope since an extremely limited amount of useable area, in
relation to the overall lot size, remains in the rear yard.
Once the lap pool (proposed separately for therapeutic
purposes) is in place, the useable rear yard space will be
reduced by approximately one third, to approximately 8% of
the entire lot. Given the location of the lap pool , and the
distribution of useable space on the lot, there is no
reasonable alternative location on this property to
accommodate the deck.
Section 2: That the permit will result in no significant
adverse effect on neighboring properties since the proposed
deck would not be in the direct line of site from adjacent
properties and would not be visible from any public street.
The deck would be visible from a private driveway extending
from Rolling Ridge Road immediately below the subject
property; however, the viewing areas of the homes served by
this road are oriented away from the proposed deck toward the
north and northwest. To further ensure that impacts of the
deck on neighboring properties are minimized and to satisfy
the requirements of this finding, conditions addressing
geology, drainage, landscaping, and the appearance of the
deck are imposed in Exhibit 'A' .
Section 3: That there will be insignificant disturbance
to the slope since the only grading proposed on the extreme
slope is for footings for the deck.
Section 4: That the permit approval is not contrary to
the general plan or coastal specific plan since the proposed
deck would not impact identified view corridors or overlay
control districts. Disturbance to the extreme slope would be
minimized. Conditions would be imposed to ensure that impacts
on adjacent properties are minimized.
Section 5: That the proposed project is categorically
exempt (Class III ) from the requirements of the California
Environmental Quality Act.
Section 6: For the foregoing reasons, the Planning
Commission of the City of Rancho Palos Verdes hereby approves
Extreme Slope Permit No. 8 subject to the conditions of
approval in Exhibit 'A' , said conditions being necessary to
preserve and protect the public health, safety, and welfare.
PASSED, APPROVED AND ADOPTED this 25th day of October,
1988.

EXHIBIT 'A'
Conditions of Approval for Extreme Slope Permit No. 8
1) Construction of the deck shall be in substantial
conformance with the plans reviewed and approved by the
Planning Commission and with all conditions of this
permit.
2) Construction of the deck shall conform to all applicable
Building Code and Development Code standards.
3) Written permission to construct the deck must be obtained
from all affected easement holders and submitted to the
Director of Environmental Services prior to issuance of a
building permit.
4) A geology report and drainage plan shall be submitted for
the review and approval of the Building Official prior to
issuance of a building permit.
5) A landscaping plan shall be submitted for the review and
approval of the Environmental Services Director prior to
issuance of a building permit.
6) The color of the deck shall be reviewed and approved by
the Director of Environmental Services prior to issuance
of a building permit.
7 ) Written acceptance of this permit and all conditions of
approval be provided to the Director of Environmental
Services within thirty ( 30) days of final approval .
8) This permit shall expire in 180 days unless extended by
the Planning Commission prior to expiration.
