RESOLUTION NO. 88-58 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DENYING THE APPEAL OF MINOR EXCEPTION PERMIT NO. 286 THEREBY APPROVING THE PROJECT AT 27016 GRAYSLAKE ROAD. WHEREAS, the Director of Environmental Services approved Minor Exception Permit No. 286 for a 90 foot ham radio antenna tower located at 27016 Grayslake; and WHEREAS, on August 1, 1988, Russell Harrison filed an appeal to the Planning Commission within 15 days of the decision of the Director of Environmental Services; and WHEREAS, on October 11, 1988, the Planning Commission considered the appeal of Minor Exception Permit No. 286 at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: The proposed antenna tower does not substantially have an adverse effect on the value of neighboring properties. Section 2: The proposed antenna tower and array does interfere with the primary view, as defined in the Development Code, of lots within 500 feet of the subject lot. Section 3: The proposed antenna tower, as conditioned in Exhibit "A", approximately balances the applicant's right of free speech with the goals of the City's General Plan and Development Code. Section 4: That after consideration of the appeal of Minor Exception Permit No. 286, the Planning Commission denied the appeal and thereby approved the project at 27016 Grayslake subject to the conditions of approval in Exhibit "A" of this Resolution. The tower may be extended to a maximum height of 89' (plus the 1 ft. mast with antenna array); however, said tower shall be retracted to its minimum nesting height of approximately 2314" feet (plus 1 foot mast array) when not in use for ham radio operation. 2. All appropriate permits shall be obtained from the City, prior to the installation of said tower. 3. Any changes to the proposed tower or mast (excluding antenna array) shall first be approved by the City. 4. No guy wires shall be used to support the tower. 5. The size of the antenna array shall be limited to a 31.5 foot maximum element length and shall not be a dish configuration. P.C. Resolution No. 88-58 Page 2
