A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF RANCHO PALOS VERDES APPROVING VARIANCE
NO . 210 FOR A GARAGE AND BALCONY ADDITION WHICH
ENCROACHES INTO AN AREA OF EXTREME SLOPE .
WHEREAS , Sharon Graner has requested a Variance for a
proposed addition over a slope which exceeds 35% in steepness ; and
WHEREAS , after notice issued pursuant to the provisions of
the Rancho Palos Verdes Development Code , a public hearing was
held on September 13 , 1988 , at which time all interested parties
were given an opportunity to be heard and present evidence ;
NOW, THEREFORE , THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS :
Section 1 : That there are special circumstances related to
the topography of the property which are not generally found on
other lots in the same zoning district , since the subject parcel
was legally created with an average slope greater than 35% .
Section 2 : That there are special circumstances which
unreasonably restrict the applicant ' s ability to develop the
property in conformance with City development regulations , in that
there is no other area available on the site to expand the
residence which would not involve an area of extreme slope .
Section 3 : That approval of the Variance will not confer a
special privilege on the applicant in relation to similarly
situated property owners in the same zoning district , in that
similar property in the same zoning district would be allowed to
construct similar additions .
Section 4 : That approval of the Variance will not cause
materially detrimental effects on surrounding properties , in that
the addition complies with Code setback height and open space
requirements and will not impair the primary views from
surrounding properties .
Section 5 : For the foregoing reasons , the Planning Commission
of the City of Rancho Palos Verdes hereby approves Variance No .
210 for a garage and balcony addition which will encroach into an
area of extreme slope located at 69 Headland Drive .
PASSED, APPROVED and ADOPTED this 13th day of September,
1988 .
