A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
RANCHO PALOS VERDES GRANTING A NEGATIVE DECLARATION,
CONDITIONAL USE PERMIT NO. 137 , VARIANCE NO . 202 AND
GRADING NO . 1114 FOR A NEW FIRE STATION LOCATED AT
29516 MIRALESTE PLAZA.
WHEREAS , the Consolidated Fire Districts of Los Angeles
County has requested approval of a Negative Declaration for
Environmental Assessment No . 546 , Conditional Use Permit No . 137 ,
Variance No . 202 and Grading 1114 to construct a new fire station
in an Institutional ( I ) zoning district ; and
WHEREAS , after notice issued pursuant to the provisions of
the City ' s Development Code , a hearing was held on September 13 ,
1988 at which time all interested parties were given an
opportunity to be heard and to present evidence .
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS :
Section 1 : That the proposed construction of a fire station
is permitted in the zone , subject to the issuance of a Conditional
Use Permit .
Section 2 : That the proposal will have no significant
impacts on the environment , due to the implementation of the
mitigation measures contained in the Final Negative Declaration
for E.A. No . 546 , which have been incorporated into the conditions
of approval in Exhibit "A" of this resolution.
Section 3 : That the proposed project is not contrary with
the intent of the General Plan.
Section 4 : That , given the project ' s location, design, and
the uses adjacent to the subject property, which include retail
commercial , a park maintenance facility and recreational open
space , granting the Conditional Use Permit will not adversely
affect the peace , health, safety or general welfare of the area,
nor will it be materially detrimental to property values ,
jeopardize , endanger or otherwise constitute a menace to the
public health, safety or general welfare of person or properties
in the surrounding area.
Section 5 : That the subject property, which fronts Miraleste
Plaza, a fully developed street with curbs , gutters , and street
lights , is adequately served by public and private facilities and
by a highway of sufficient width and improvements to carry the
kinds and quantity of traffic the proposed use might generate .
Section 6 : That there are exceptional and extraordinary
conditions related to the size , shape and configuration of the
property which are not generally found on other lots in the same
zoning district , since the subject parcel is triangular in shape
and abuts public streets on all three sides .
Section 7 : That the Variance is necessary for the
preservation and enjoyment of a substantial property right , which
right is possessed by other property owners under like conditions
in the same zoning district , in that if new development was
required to respect the street side setback , the available area
outside the setbacks would be inadequate in size to accommodate a
fire station.
Section 8 : That granting of the Variance will not have
materially detrimental effects on surrounding properties , in that
the site is currently being used as a fire station and the
facility provides necessary emergency service to the community .
Section 9 : That the granting of such a Variance will not be
contrary to the general plan , since the project will provide
necessary emergency service as identified in the Safety Element of
the General Plan.
Section 10 : For the foregoing reasons , the Planning
Commission of the City of Rancho Palos Verdes hereby grants a
Conditional Use Permit for the uses described herein, subject to
the conditions of approval in Exhibit "A" , which are necessary to
protect the public health, safety and general welfare in the area
and will make possible development of the City in an orderly and
efficient manner and in conformity with the intent and purposes
set forth in this title .

EXHIBIT "A"
CONDITIONS OF APPROVAL
CONDITIONAL USE PERMIT NO . 137
1 . Prior to the issuance of any demolition or building permits ,
the Consolidated Fire Districts of Los Angeles County must
obtain a street vacation from the City of Rancho Palos Verdes
for that portion of the site owned by the Palos Verdes
Homeowners Association and shall perform a lot merger to
combine the four affected parcels into a single lot . A ten
( 10 ) foot strip of road easement shall be preserved along
Palos Verdes Drive East and Miraleste Drive for public
sidewalk purposes .
2 . All structures located within the 60 foot intersection
visibility triangles shall be limited to 30 inches above the
curb . Trees which overhang the area shall have their
foliage maintained at 8 feet above the level of the sidewalk .
3 . Eleven parking spaces shall be provided on the site : three
inside the building for emergency vehicles , four spaces to
the rear of the building (one of which may be a compact
space ) and four spaces in the front of the building (one of
which shall be a handicapped space ) . No parking spaces shall
be located in the intersection visibility triangle .
4 . The maximum height of the structure above the level of the
pad shall not exceed 28 feet .
5 . The flag pole shall not exceed 30 feet in height from grade .
6 . The applicant shall submit landscape and fencing , lighting ,
and irrigation plans for review and approval by the Director
of Environmental Services .
7 . The applicant shall provide a trash enclosure on the subject
site that shall be enclosed on four ( 4) sides by a solid
structure or wall , six (6 ) feet in height , constructed of
material compatible with the main structure and screened from
view from any public street . One side of the structure shall
be a solid , self-latching gate adjacent to adequately paved
concrete access for collection.
8 . Any roof-mounted equipment not included in this application
shall be subject to the review and approval of the Director
of Environmental Services .
9 . The landowner shall submit a soils and geology report prior
to final approval of the grading plan by the Director of
Environmental Services and the City Engineer. All

recommendations made by the soils engineer and geologists
shall be incorporated into the design and construciton of the
project .
10 . Hours demolition and construction shall be 7 :00 a.m. to
7 :00 p .m. Monday through Friday ;, with no construction
permitted on weekends and holidays .
11 . The circulation pattern shall not be modified from the
proposed U-shaped driveway with access off of Miraleste
Plaza, except through a major revision to the Conditional Use
Permit .
