A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF RANCHO PALOS VERDES APPROVING VARIANCE NO. 208 AND
CONDITIONAL USE PERMIT NO. 23 REVISION "DD" FOR AN
EXISTING ACCESSORY STRUCTURE THAT ENCROACHES INTO THE
REQUIRED SIDE YARD SETBACK AND EXCEEDS THE MAXIMUM LOT
COVERAGE AT 3314 PALO VISTA DRIVE.
WHEREAS , Mr. Peter Aguilera has requested approval for an
existing accessory structure located in the east side yard
setback; and
WHEREAS , after notice issued pursuant to the provision of the
Rancho Palos Verdes Development Code, a public hearing was held on
September 13 , 1988, at which time all interested parties were
given an opportunity to be heard and present evidence ;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS :
Section 1 : That there are special circumstances related to
the size , shape and topography of the property which are not
generally found on other lots in the same zoning district , since
the property is within a Residential Planned Development with
smaller lot sizes than the RS-1 zoning standards .
Section 2 : That there are special circumstances which
unreasonably restrict the applicant 's ability to develop the
property in conformance with City development regulations , in that
the existing accessory structure was built at the same time as the
residence and the landowner made a good faith effort to build the
structure in conformance with the zoning requirements.
Section 3 : That approval of the Variance will not confer a
special privilege on the applicant in relation to similarity
situated property owners in the same zoning district, in that the
residence was developed prior to the adoption of the Seacliff
Hills Development Guidelines in September 1986 which imposes
stricter open space requirements on new development .
Section 4: That approval of the Variance will not cause
materially detrimental effects on surrounding properties, in that
the accessory structure is of an architectural style that blends
with the main residence .
Section 5 : For the foregoing reasons, the Planning
Commission of the City of Rancho Palos Verdes hereby approves
Variance No. 208 and Conditional Use Permit No. 23 Revision "DD"
for an existing accessory structure which encroach into required
setbacks and exceeds the lot coverage requirement at 3314 Palo
Vista Drive .
PASSED, APPROVED and ADOPTED this 13 day of September, 1988 .
