PC RES 1988-043 P.C . RESOLUTION NO. 88- 43
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF RANCHO PALOS VERDES APPROVING VARIANCE
NO. 203 AND GRADING NO. 1127 AT 99 VANDERLIP DR.
WHEREAS , John M. Vanderlip has requested a Variance and
Grading Application to allow a partially constructed garage into
an extreme slope at 99 Vanderlip Drive ;
WHEREAS , after notice pursuant to the City ' s Development Code
a public hearing was held on July 26 , 1988 , at which time all
interested parties were given an opportunity to be heard and
present evidence ;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS :
Section 1 : That there are exceptional or extraordinary
circumstances or conditions that exist relative to this property
which do not apply generally to other properties in the same
district in that the property does have extreme slopes along the
rear and side yards which is not typical for other properties in
the same zoning district .
Section 2 : That such Variance is necessary for the
preservation and enjoyment of a substantial property right of the
applicant which right is possessed by others under like
circumstances in the same zoning district since other properties
would be required to provide a 2-car garage .
Section 3 : That the granting of a Variance would not result
in adverse effects to the public welfare or the surrounding
development patterns because the garage will be modified in height
to adhere to the Development Code and has been conditioned to
minimize soil instability and water runoff .
Section 4 : That the granting of such a Variance for the
modified garage will not be contrary to the objectives of the
General Plan and the Natural and Urban Overlay Districts .
Section 5 : As conditioned, the grading is not excessive
beyond that necessary for the permitted primary use of the lot ,
does not significantly adversely affect the visual relationship
with, nor the views from neighboring sites .
Section 6 : For the foregoing reasons , the Planning Commission
of the City of Rancho Palos Verdes hereby approves Variance No.
20.3 and Grading Application No . 1127 , subject to the conditions of
approval as listed in the attached Exhibit "A" which have been
deemed necessary to promote the public health, safety and welfare
of the area.
