A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF RANCHO PALOS VERDES APPROVING VARIANCE
NO. 191 FOR AN EXISTING WATER HEATER AND DENYING
THE EXISTING LAUNDRY FACILITIES WHICH ENCROACHES
INTO THE MINIMUM INTERIOR GARAGE DIMENSIONS AT
28611 PLAINFIELD DRIVE.
WHEREAS, Ara ~Issari and Steve Housang have requested a
Variance for the existing water heater and laundry facilities
at 28611 Plainfield Drive; and
WHEREAS, after notice issued pursuant to the provisions of
the Rancho Palos Verdes Development Code, a public hearing was
held on March 8, 1988 and June 28, 1988, at which time all
interested parties were given an opportunity to be heard and
presented evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: That there are no exceptional or extraordinary
circumstances or conditions applicable to the property involved
which do not apply generally to other properties in the same
zoning district; in that the laundry facilities could be
accommodated in another area on the property without requiring a
Variance.
Section 2: That a Variance for the water heater is necessary
for the preservation and enjoyment of a substantial property right
of the applicant, which right is possessed by other property
owners under like conditions in the same zoning district, in that
the water heater has been installed to comply with Building Code
requirements and encroaches only 3 square feet into the minimum
garage requirements.
Section 3: That the granting of the Variance for the water
heater is not contrary to the General Plan.
Section 4: That the Variance for the water heater will not
have a detrimental effect on the environment since the water
heater constitutes a very minor encroachment into the minimum
garage dimensions and would still allow enough area in which to
park two vehicles.
Section S: For the foregoing reasons, the Planning Commission
of the City of Rancho Palos Verdes hereby approves Variance No.
191 for the water heater, subject to the condition that the
landowner obtain the necessary building permits and denies the
request for the existing laundry facilities, thereby requiring
their relocation within 60 days of this decision.
