PC RES 1988-033 P.C. RESOLUTION NO. 88-33
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF RANCHO PALOS VERDES APPROVING REVISION "B" TO
CUP NO. 101 FOR A PROJECT LOCATED AT 28849 WESTERN AVE.
WHEREAS , Colorado South Bay Associates , Ltd . has requested a
re-classification of certain uses from non-retail to retail for
the shopping center located at the south west corner of Western
Avenue and C ad d ing ton Drive.
WHEREAS , a public meeting was held on Tuesday, May 10, 1988,
at which time all interested parties were given the opportunity to
give testimony and present evidence .
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND , DETERMINE AND RESOLVE AS FOLLOWS:
Section 1 : That there will be no significant environmental
impacts resulting from this revision in that the mitigation
measures of the Final Negative Declaration for Environmental
Assessment No . 477 shall continue to apply.
Section 2 : That the revision results in a net reduction
of the project size and net increase in parking spaces , thereby
meeting the findings for the project made in P .C. Resolution No.
86-28.
Section 3 : That the attached Conditions of Approval in
Exhibit "A" will ensure that the project is developed and leased
in the intended manner.
Section 4 : For the foregoing reasons , the Planning Commission
of the City of Rancho Palos Verdes does hereby approve the
revisions to the project subject to the conditions contained in
Exhibit "A" , which are necessary to preserve the public health,
safety and general welfare in the area.

EXHIBIT "A"
CONDITIONAL USE PERMIT NO. 101 - REVISION B
CONDITIONS OF APPROVAL
1 . Conditions of P .C. Resolution No . 86-28 are revised to read:
10 . The project shall have, as a minimum, 781 parking spaces
with a maximum of 20% as compact spaces .
17. The total net leaseable floor area shall not exceed
181, 556 square feet. A maximum of 28, 141 square feet of net
leaseable area shall be allowed for non-retail ; such uses shall be
subject to the determination of the Director of Environmental
Services .
All other conditions of PC Resolution No . 86-28 shall continue
to apply to the project.
2. The theater use ( 18, 320 square feet, net leaseable) is a retail
use.
3. The applicant shall submit to the City a revised parking plan
designating employee parking areas and shall ensure that employees
use said spaces , once approved . This condition shall apply to all
future owners of the property.
4. The applicant shall submit certification of net leaseable space
per tenant space prior to issuance of occupancy permit to ensure
that the ratio of net leasable to parking spaces is maintained.
5. The main entrance to the theater shall be maintained on the
eastern side of the building.
6. The hours of operation of the theater are limited to begin no
earlier than 1 pm weekdays and noon on weekends , and the theater
is to be vacated by the public no later than 2 a.m.
7. The developer shall submit to the City an agreement
limiting administrative and professional office uses , financial
institutions , and other non-retail uses to no more than 15 . 5% of
net leaseable area and prohibiting medical and dental offices .
This language is be reviewed and approved by the Director of
Environmental Services and the City Attorney prior to recordation.
8. Level C is limited to 12, 600 square feet of non-retail net
leaseable , excluding the movie theater .

9. In the event that the movie theater use proposes to change its
operation to present theatrical productions, adult or "X-rated"
entertainment or movies, to a restaurant use or other non-retail use,
such a change shall be reviewed by the Planning Commission to consider
hours of operation, impact of traffic and/or parking demand, and other
related issues.
