P.C. RESOLUTION NO. 88 - 25
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF RANCHO PALOS VERDES APPROVING
VARIANCE NO. 198 (A) TO THE NONCONFORMING
PROVISIONS OF THE DEVELOPMENT CODE TO
ESTABLISH A NEW USE AT 28041 HAWTHORNE BLVD.
WHEREAS , Mr. Ray Ne j ad has requested a Variance from the
nonconforming provisions of the Development Code , relative to
the establishment of a new use in an existing commercial building
located in a residential zone at 28041 Hawthorne Boulevard; and
WHEREAS , after notice issued pursuant to the provision of the
Rancho Palos Verdes Development Code, a public hearing was held on
April 12, 1988 at which time all interested parties were given an
opportunity to be heard and present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND , DETERMINE AND RESOLVE AS FOLLOWS :
Section 1 : That there are exceptional or extraordinary
circumstances or conditions applicable to the property which do
not apply generally to other properties in the same zoning
district, in that the property is developed with a legal
nonconforming commercial use.
Section 2 : That the Variance is necessary for the
preservation and enjoyment of a substantial property right of the
landowner , since the property was developed in conformance with
Los Angeles County zoning and General Plan requirements in effect
at the time and staff has determined that commercial development
is still the most appropriate use of the site .
Section 3 : That the granting of the Variance will not be
materially detrimental to the public health, safety and welfare ,
since the landowner is not proposing to physically expand the
building and the building has been fully occupied in the past, and
there is adequate parking available in the south parking lot to
accommodate full occupancy of the ground floor of the building.
Section 4 : That the legal nonconforming status of the
property supersedes the requirement for the project to comply with
the standards of the General Plan.

Section 5 : For the foregoing reasons , the Planning
Commission of the City of Rancho Palos Verdes hereby approves
Variance No . 198 (A) , subject to the conditions of approval in
Exhibit "A" .
PASSED , APPROVED and ADOPTED this 26th day of April , 1988.

EXHIBIT "A"
VARIANCE 198 (A)
Condition of Approval
1 . The video rental store shall be allowed temporary signage
consistent with the requirements in a CL Zone until a sign
program is established for the entire building through the
Development Agreement. Said temporary sign shall be subject
to review and approval by the Director of Environmental
Services .
