PC RES 1988-022 P.C. RESOLUTION NO. 88- 22 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING VARIANCE NO. 188 (A) FOR AN EXISTING SUN DECK WHICH EXCEEDS THE 30 FOOT DOWNSLOPE HEIGHT AT 28053 LOBROOK DR. WHEREAS, Staff determined that a Variance was required to approve an existing sun deck which exceeds the 30 foot downslope height located at 28053 Lobrook Drive which is owned by Mr. Fred Fenger ; and WHEREAS , after notice issued pursuant to the provision of the Rancho Palos Verdes Development Code , a public hearing was held on April 12, 1988 at which time all interested parties were given an opportunity to be heard and present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS : Section 1 : That granting the Variance is appropriate due to administrative error , since the City approved a Site Plan Review application and finalized a building permit for the sun deck in conflict with the requirements of the Development Code . Section 2 : The project is subject to the condition that the landowner submit a landscape plan for review and approval of the Director of Environmental Services . The landscape plan shall include the use of mature specimens to visually screen the deck from adjacent properties located to the north and south to be located in the rear yard adjacent to the structure and in planters located on the sun deck. The plan shall include a specimen list, proposed spacing , irrigation and size of individual plants and a maintenance schedule. Section 3 : For the foregoing reasons , the Planning Commission of the City of Rancho Palos Verdes hereby approves Variance No . 188 (A) .
