A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF RANCHO PALOS VERDES
APPROVING VARIANCE NO. 197 AT 28525
TRAILRIDERS DRIVE .
WHEREAS , Rolf H. Klemm has requested a Variance for an
exciting deck encroaching into an area of extreme slope at the
rear of the subject property; and
WHEREAS , after notice issued pursuant to the provision of the
Rancho Palos Verdes Development Code , a public hearing was held on
April 12 , 1988 , at which time all interested parties were given an
opportunity to be heard and present evidence;
NOW, THEREFORE , THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HERERBY FIND, DETERMINE AND RESOLVE AS FOLLOWS :
Section 1 : That there are exceptional or extraordinary
circumstances or conditions applicable to the property involved ,
or to the intended use of the property, which do not apply
generally to other property in the same zoning district , since the
site cannot reasonably accommodate the structure in another
location not involving an extreme slope .
Section 2 : That such Variance is necessary for the
preservation and enjoyment of a substantial property right of the
applicant which right is possessed by other property owners under
like conditions in the same zoning district ; since other
properties in the area have decks of similar size that extend over
their rear slopes .
Section 3 : That the granting of the Variance will not be
materially detrimental to the public welfare or injurious to
property and improvements in the area in which the property is
located ; since the deck will not increase runoff and there is an
insignificant disturbance to the slope .
Section 4 : That the granting of such Variance will not be
contrary to the objectives of the General Plan; since the deck
will cause no view impairment , or visual impact and will blend
with the hillside .
Section 5 : That for the foregoing reasons , the Planning
Commission of the City of Rancho Palos Verdes hereby approves
Variance No . 197 subject to the conditions of approval attached in
Exhibit "A" .
PASSED , APPROVED and ADOPTED this 12th day of April , 1988 .

EXHIBIT "A"
VARIANCE NO. 197
1 . The deck shall be redesigned so that the maximum encroachment
into the extreme slope does not exceed 6 feet and the overall
size does not exceed 337 square feet .
2 . The landowner shall submit a landscape plan for the area
around the deck subject to the approval of the Director of
Environmental Services prior to the issuance of building
permits .
3 . The deck shall be maintained in a color that blends with the
natural landscape subject to the approval of the Director of
Environmental Services .
4 . The applicant shall provide complete geology and hydrology
reports which address the deck, subject to the review and
approval of the Building Division.
