A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF RANCHO PALOS VERDES FOR
VARIANCE NO. 187 DENYING AN EXISTING
ACCESSORY STRUCTURE AND DECK WHICH ENCROACH
INTO REQUIRED SETBACKS AND AN AREA OF EXTREME
SLOPE AT 28603 MOUNT PALOMAR PLACE.
WHEREAS, Fernando and Elizabeth Formeloza have requested a
Variance for an existing accessory structure and deck which
encroach into required setbacks and an area of extreme slope and
a second upslope retaining wall (see P.C. 88 - ); and
WHEREAS, after notice issued pursuant to the provisions of
the Rancho Palos Verdes Development Code, a public hearing was
held on February 9, 1988, at which time all interested parties
were given an opportunity to be heard and present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: That there are no special circumstances related
to the size, shape and topography of the property which are not
generally found on other lots in the same zoning district, (except
as described in P.C. 88 - for the second upslope retaining wall)
since the subject property is a typical graded pad lot found
throughout the Eastview area.
Section 2: That there are no special circumstances which
unreasonably restrict the applicant's ability to develop the
property in conformance with City development regulations, in that
the property has a reasonable amount of level outdoor yard area
adjacent to the residence.
Section 3: That approval of the Variance will confer a
special privilege on the applicant in relation to similarly
situated property owners in the same zoning district, in that the
view taken from inside required setbacks is not a protected view
under the Development Code.
Section 4: That approval of the Variance will cause
materially detrimental effects on surrounding properties, in that
such a structure in close proximity to other properties would have
a detrimental effect on the privacy, peace and quiet of adjacent
properties.
Section 5: For the foregoing reasons, the Planning
Commission of the City of Rancho Palos Verdes hereby denies
Variance No. 187 for an existing accessory structure and deck
which encroach into required setbacks and an area of extreme
slope at 28603 Mt. Palomar.
PASSED, APPROVED and ADOPTED this 23rd day of February 1988.
