A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF RANCHO PALOS VERDES
APPROVING VARIANCE NO. 185 FOR A WALL,
HOT TUB AND PLANTER WALL AT 30252 VIA
VICTORIA.
WHEREAS, Derek and Edna Steel have requested a Variance to
allow an existing wall , hot tub and planter wall exceeded the
maximum allowed heights and located within the front 20 foot
setback at 30252 Via Victoria.
WHEREAS , after notice pursuant to the City' s Development
Code, a hearing was held on January 26 , 1988, at which time all
interested parties were given an opportunity to be heard and
present evidence .
HOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS :
Section 1 : That there are exceptional or extraordinary
circumstances or conditions applicable to the property since the
large master bedroom window does not allow for privacy.
Section 2 : That a Variance is necessary to preserve or allow
the enjoyment—of a substantial property right of the applicant
which is possessed by other property owners under similar
conditions in the same zoning district , since the walls and hot
tub are uses that are allowed within the zoning district and are
consistent with uses on other similar properties .
Section 3 : That the granting of the Variance will not be
materially detrimental to the public welfare or injurious to
property and improvements in the area in which the property is
located, since the structures blend with the architecture of the
residence and Building and Safety code requirements shall be met .
Section 4 : That the granting of the Variance will not be
contrary to the objectives of the General Plan, as there are no
negative impacts since the structure enhances the physical and
visual character of _ the property and neighborhood.
Section 5 : That, as a condition of approval , the walls, hot
tub, and mechanical and electrical equipment, and glass master bed-
room door shall conform to all Building and afety code requirements .
Section 6 : That, as a condition of approval , the existing
landscaping must be properly maintained to screen the existing
wall which encloses the patio.
Section 7 : That, as a condition of approval , the existing
walls must be maintained with a color and material that blends
with the existing residence.
Section 8 : For the foregoing reasons , the Planning
Commission of the City of Rancho Palos Verdes hereby approves
Variance No. 185 .
APPROVED and ADOPTED this 26th day of January, 1988 .
