A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF RANCHO PALOS VERDES RECOMMENDING TO THE
CITY COUNCIL THE APPROVAL OF A DEVELOPMENT AGREEMENT
TO ACCOMPANY GENERAL PLAN AMENDMENT NO. 16 , ZONE
CHANGE NO. 15, AND RECOMMENDING APPROVAL OF A
FINAL NEGATIVE DECLARATION FOR ENVIRONMENTAL
ASSESSMENT NO. 538 .
WHEREAS , the City Council initiated General Plan Amendment
No . 16 and Zone Change No. 15, to change the existing general plan
designation from residential to commercial retail and to change
the existing zoning from residential single family (RS-5 ) to
commercial limited (CL) at the property owner ' s request for
property located at 28041 Hawthorne Boulevard; and
WHEREAS, the Planning Commission held public hearings on
these matters on August 11 , August 25 , and September 8, 1987 , at
which time all interested parties were given an opportunity to be
heard and present evidence; and
WHEREAS, the Planning Commission recommended that the City
Council change the general plan designation to commercial retail
and the zoning to commercial limited provided that a development
agreement between the City and the property owner is executed to
control the use and operation of the site .
WHEREAS, on November 24 , December 8, 1987 and January 12 ,
1988 the Planning Commission held public hearings to consider the
Development Agreement; and
NOW, THEREFORE, the Planning Commission of the City of Rancho
Palos Verdes does hereby recommend to the City Council as follows :
Section 1 : That the Planning Commission has reviewed and
considered the Initial Study for Environmental Assessment No. 538
in reaching its decision to recommend approval of the development
agreement . Further, the Planning Commission finds that the
approval of the agreement will not result in significant adverse
environmental impact because the agreement would control the
impacts of the operation of businesses at the site by addressing
permitted uses , hours of operation, non-conforming uses and
signage .
Section 2 : That the Planning Commission finds that the
agreement is consistent with the General Plan (Amendment No . 16)
since the proposed amendment will designate the property for
commercial use and since the general plan encourages the rigorous
control of the impacts of commercial development, particularly
when adjoining residential uses .
Section 3 : That the Planning Commission finds that the
provisions of the agreement will mitigate the potentially adverse
environmental impacts identified in the Initial Study for
Environmental Assessment No . 512 .
Section 4 : For the foregoing reasons , the Planning
Commission of the City of Rancho Palos Verdes hereby recommends
approval of this development agreement ( attached as Exhibit "A" )
to accompany General Plan Amendment No . 16 , Zone Change No . 15 ,
and a Final Negative Declaration.
