A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF RANCHO PALOS VERDES UPHOLDING THE APPEAL
OF HEIGHT VARIATION NO. 509 THEREBY DENYING THE
PROJECT AT 86 ROCKINGHORSE ROAD.
WHEREAS, the Director of Environmental Services approved
Height Variation No . 509 for a second story addition located at 86
Rockinghorse Road; and
WHEREAS , on October 6 , 1987 , Captain and Mrs . Virjee filed an
appeal within 15 days of the decision of Director of Environmental
Services; and
WHEREAS , on December 8 , 1987 , the Planning Commission heard
the appeal at which time all interested parties were given an
opportunity to be heard and present evidence .
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND , DETERMINE AND RESOLVE AS FOLLOWS :
Section 1 : That the proposed structure is not designed and
situated in such a manner as to minimize view obstruction in that
there are other design options to build outward along the sides
and front or build down towards the street , creating a downsloping
building configuration, and thereby altering the height measuring
criteria .
Section 2 : That the view impairment for the portion of the
proposed addition over sixteen feet high does significantly
impair the primary view as determined by the Planning Commission
of the harbor and city lights from 84 Rockinghorse Road , which was
identified by the Planning Commission as an upsloping lot and as
having a view over the subject parcel as set forth in the City' s
Development Code .
Section 3 : That after consideration of the appeal of Height
Variation No. 509 , the Planning Commission upheld the appeal and
thereby denies the project at 86 Rockinghorse Road .
PASSED, APPROVED and ADOPTED on January 12 , 1988 .
