RESOLUTION P .C . NO. 87 - 70
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF RANCHO PALOS VERDES APPROVING VARIANCE
NO. 177 FOR A SOLID WALL IN THE FRONT YARD SET-
BACK AT 27839 HAWTHORNE BOULEVARD.
WHEREAS , Mr. Robert Wilson has requested a Variance for an
existing solid freestandng wall located within the front yard
setback; and
WHEREAS , after notice issued pursuant to the provisions of
the Rancho Palos Verdes Development Code , a public hearing was
held on November 10 , 1987 , at which time all interested parties
were given a opportunity to be heard and present evidence;
NOW, THEREFORE , THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS :
Section 1 : That there are special circumstances related to
the size , shape and topography of the property which are not
generally found on other lots in the same zoning district , in that
the wall has been in existence for eighteen years and was built
before the City incorporated .
Section 2 : That there are special circumstances which
unreasonable restrict the applicant ' s ability to develop the
property in conformance with City development regulations , in that
the landowner purchased the property with the expectation of
utilizing the pre-existing wall as part of the residential
improvements on the lot .
Section 3 : That approval of the Variance will not confer a
special privilege on the applicant in relation to similarly
situated property owners in the same zoning district , in that the
wall shall be required to be removed or modified to meet current
City Development Codes upon change in the current ownership of the
property.
Section 4 : That approval of the Variance will not cause
materially detrimental effects on surrounding properties , in that
the wall has existed for eighteen years and shall be modified to
mitigate its visual impact until such time as there is a change in
property ownership.
Section 5 : For the foregoing reasons , the Planning
Commission of the City of Rancho Palos Verdes hereby approves
Variance No . 177 for an existing solid wall in the front yard
setback which is 6 feet in height , subject to the conditions of
approval in Exhibit 'A' at 27839 Hawthorne Boulevard .

EXHIBIT "A"
Variance No. 177
1 . The landowner shall record a Deed Restriction with a sunset
clause specifying that the wall shall be brought into
conformance with City Codes upon change of property
ownership.
2 . A landscape plan shall be submitted , subject to the review
and approval of the Director of Environmental Services .
3 . The wall shall be painted a neutral tone that blends with the
surroundings , subject to the approval of the Director of
Environmental Services .
4 . The landowner shall obtain all necessary permits for the
motorized gate from the Building Division.
5 . The brick wall on either side of the driveway shall be
removed within 60 days of the date of approval .
6 . The landowner shall comply with all conditions within 60 days
of the date of approval .
