PC RES 1987-063} RESOLUTION P.C. NO. 87 - 63 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING VARIANCE NO. 176 FOR A TWO CAR GARAGE AT 28707 MT. LANGLEY COURT. WHEREAS, Dan J. Delight has requested a Variance to allow an addition which encroaches 12 feet into the required 17 foot rear setback from the toe of the slope at 28707 Mt. Langley Court. WHEREAS, after notice pursuant to the City's Development Code, a hearing was held on October 27, 1987, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section l: That there are exceptional or extraordinary circumstances or conditions applicable to the property since the property is at the end of a cul-de-sac which limits on street parking and many other structures in the neighborhood have similar reduced setbacks. Section 2: That a Variance is necessary to preserve or allow the enjoyment of a substantial property right of the applicant which is possessed by other property owners under similar conditions in the same zoning district, since the setback requirement severely limits any further development on the lot, although all other Code criteria can be met. Section 3: That the granting of the Variance will not be materially detrimental to the public welfare or injurious to property and improvements in the area in which the property is located, since the structure will cause no view blockage, and the addition will exceed the minimum zoning district setback from the rear property line. Section 4: That the granting of the Variance will not be contrary to the objectives of the General Plan, since a garage is a permitted use in a residential zone and a minimum 2 car garage is required by the Development Code. Section 5: That as a condition of approval the garage wall adjacent to the rear property line be structural designed as a retaining wall. Resolution P.C.
